Accessory Use-Specific Standards

4.3.5.

A. General Standards for a specific accessory use or structure shall apply to the particular individual accessory use or structure regardless of the zoning district in which it is located or the review procedure by which it is approved, unless otherwise specified in this Ordinance. This section sets forth and consolidates the standards for all accessory uses and structures for which a reference to this section is provided in the “Use-Specific Standards” column of the accessory use/structure table in 4.3.4, Accessory Use/Structure Table, and in the same order as they are listed in the table. These standards may be modified by other applicable standards or requirements in this Ordinance. B. Standards for Specific Accessory Uses and Structures Accessory Apartment An accessory apartment is allowed only as accessory to, and on the same lot as, a single-family detached dwelling unit (excluding bungalow courts and pocket neighborhoods where it is expressly prohibited), duplex dwelling unit, single-family attached dwelling unit, or a live/work dwelling, subject to the following standards: a. There shall be no more than one accessory apartment on a lot. b. An accessory apartment may be a detached structure (e.g., an apartment above a detached garage or a guesthouse). c. An accessory apartment may be within the principal dwelling (e.g., a downstairs or upstairs apartment). d. A manufactured home, recreational vehicle, or travel trailer shall not be used as an accessory apartment. e. The floor area of an accessory apartment within a principal dwelling shall be no more than 1,000 square feet (excluding carports and garages). f. The height of the accessory structure or use shall be visually subordinate to the principal structure and shall in no instance exceed the height of the principal structure. g. At least one off-street parking space shall be provided in addition to those required for the primary dwelling. h. An accessory apartment shall not be sold apart from the principal dwelling on the same lot. i. An accessory apartment shall not be leased or rented for tenancies of less than 30 days.
