Article 11: Interpretation and Definitions Section 11.5. Terms and Uses Defined 11.4.2. Exceptions and Variations

L AND The earth, water, and air, above, below, or on the surface, and including any mineral resources and natural resources and any improvements or structures customarily regarded as land. L AND D ISTURBING A CTIVITY Any use of the land that results in a change in the natural cover or topography that may cause or contribute to sedimentation. L ANDFILL , C ONSTRUCTION AND D EMOLITION D EBRIS A facility for the land disposal of solid waste generated solely from the construction, remodeling, repair, or demolition operations on pavement and buildings or structures. L ANDFILL , L AND C LEARING AND I NERT D EBRIS A facility for the land disposal of land clearing waste (solid waste generated solely from land clearing activities, such as stumps, trees, limbs, brush, grass, and other naturally occurring vegetative material), concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood, and yard trash (solid waste resulting from landscaping and yard maintenance such as brush, grass, tree limbs, and similar vegetative material). L ANDFILL , M UNICIPAL S OLID W ASTE A facility for the land disposal of solid waste resulting from the operation of residential, commercial, industrial, governmental, or institutional establishments that would normally be collected, processed, and disposed of through a public or private solid waste management service. L ANDFILL , O N -S ITE D EBRIS A landfill that is limited to receiving stumps, limbs, leaves, concrete, brick, wood, uncontaminated earth, or other uncontaminated solid waste from on-site construction activities. L ANDOWNER Any owner of a legal or equitable interest in real property, including the heirs, devisees, successors, assigns, and agent or personal representative of the owner. L ANDSCAPE A RCHITECT , R EGISTERED An individual registered by the State of North Carolina as qualified to practice landscape architecture by reason on their special knowledge of natural, physical, and mathematical sciences, and the principles and methodology of landscape architecture and landscape architectural design. L ANDSCAPING Shall be defined as any living plant material such as trees, shrubs, ground cover, and grass used in spaces void of impervious material or building structure. L ARGER C OMMON P LAN OF D EVELOPMENT OR S ALE Any area where multiple separate and distinct construction or land-disturbing activities will occur under one plan. A plan is any announcement or piece of documentation (including but not limited to a sign, public notice or hearing, sales pitch, advertisement, loan application, drawing, permit application, zoning request, or computer design) or physical demarcation (including but not limited to boundary signs, lot stakes, or surveyor markings) indicating that construction activities may occur on a specific plot.
