Real Estate Litigation

Mr. Mitchel S. Ross,

2 credits day; 2 credits evening. This course is taught wholly through the Socratic method. The exam is an essay exam, usually four questions. Class participation is graded by awarding a half- step increase in exam grade to students who contribute to the teaching/learning experience through class participation. The course focuses on the strategy and tactics of counseling clients and trying cases dealing with real estate, in tort, statutory and contractual contexts. This is the only section of the course.

This course explores the areas of real estate law which frequently reach Massachusetts courts. Particular attention will be paid to contested property valuations in the context of real estate tax abatement, eminent domain, contract actions and actions affecting the title, possession, or use of real property. Procedural issues will be discussed (e.g. attachments, Land Court and Housing Court practice, lis pendens, and summary process), as will other forms of civil action primarily directed to real estate issues.

Real Estate Mortgages and Conveyancing

2 credits day; 2 credits evening.

A thorough review of real property law is of top priority, following an analysis of real estate mortgage law. Finally, a practical, bread-and-butter approach to conveyancing rounds out the course. Registration for both Conveyancing and Mortgages and Real Estate Mortgages Law and Conveyancing is prohibited.
