Ondřej Vícha. The Mining Act. Act on Mining Activities, Explosives and State Mining Administration. Commentary. Wolters Kluwer ČR Publishing, Prague, 2017. Summary The presented publication is divided into several parts. In the Introduction into the mining law, the history of the development of Czech mining legislation before 1988 is illuminated. Author briefly described the history of Czech mining law in the Middle-age from 13. Century in the Czech Kingdom. Then deals with the system of recent mining law and law dealing with the area of the mining industry in Czech law. Finally, the relevant sources of mining law on the EU level as well as international conventions regarding exploration and exploitation of mineral resources are described. The core of the reviewed publication is a structured commentary on the individual provisions of the Mining Act No.44/1988 Coll., as well as of the Act on Mining Activities, Explosives and State Mining Administration No.61/1988 Coll. Introductory information regarding individual sections of these acts is included, as well as a list of relevant related provisions of both acts and also related pieces of other legislation. The case law of the Constitutional Court of the Czech Republic, general courts (mainly the Supreme Administrative court and the Supreme Court) as well as the Court of Justice of the EU are discussed. The reviewed publication reflects the state of legislation in June 2017.
