Minutes Open Session Hardwick Township Zoning Board of Adjustment March 18, 2008

There was the Regular Meeting of the Hardwick Township Zoning Board of Adjustment on Tuesday, March 18, 2008. Present were Board Members: Teresa Pflugh, John Satta, Robert Krok, William Hughes, and Alfia Schemm. Board Members absent: Louis Rossi and David Ebbels. Also present: Board Attorney Lyn Aaroe, Board Engineer Ted Rodman, and Board Secretary Alfia Schemm. Chairman Satta then led the Board in the salute to the flag. Board Attorney Aaroe administered the oath of office to Robert Krok. Board Secretary Alfia Schemm called the meeting to order at 7:38 p.m. and announced that the meeting was being held in compliance with the “Open Public Meetings Act.” Approval of Minutes : The regular meeting minutes of January 15, 2008 were distributed prior to the meeting. Ms. Pflugh made the motion to adopt the minutes. Motion seconded by Mr. Hughes. In a voice vote, all were in favor, except for Mr. Krok, who was not present at the January meeting, and abstained. Completeness: #08-001 Little Hill Foundation, Block 1102, Lot 17 Richard Keiling Esq. was present on behalf of the Applicant and he stated that they are requesting an amendment to their approved site plan for their woman’s half way house. He stated that they are looking to makes some aesthetic improvements and they also want to construct two gazebos. They are looking to install some pavers, lighting, a gate and fencing, and they wish to modify the approved parking. Board Engineer Rodman stated that the prior approved application was deemed complete and he questioned the procedure and if the Board needs to deem this amended application complete. Board Attorney Aaroe stated that the application is fairly recent and modified plans have been submitted to address the Applicant’s request and he recommended that the Board deem the application complete. Mr. Hughes made the motion to deem the application complete. Motion seconded by Ms. Pflugh. In a roll call vote, all were in favor. #08-002 Ruth and Timothy Wood, Block 801, Lot 11 Chairman Satta stated that he lives across the street from the Applicant and he

questioned whether he will need to step down. Mr. Wood stated that he has not received his 200 foot list as of yet. Board Attorney Aaroe stated that the Board is only dealing with completeness this evening, as it is administrative; however, Chairman Satta will need to recuse himself, during the hearing process, if he is within 200 feet. Board Engineer Rodman reviewed his report of March 13, 2008 and he questioned whether a height variance is even required based on the Township Ordinance and he questioned where the measurement was taken. Both Board Engineer Rodman and Board Attorney Aaroe reviewed the Ordinance and Ordinance diagram and Board Attorney Aaroe stated that he believes that the Applicant will still require the height variance. Board Engineer Rodman continued to review his report and Mr. Wood stated that he does have a drawing that shows the profile of the house in relation to the road. nofficial Document
