Hangar 5A, Runway Drive Flushing, New York 11371 Re: Updated Request for Equitable Adjustment, Retainage and March Job Costs Dear John and Sue, Spearhead anticipates completion of its Punch List items at the conclusion of today’s, 2 nd Shift. We are still waiting on both curved trim pieces for the bottom of the escalator and will return to install when they are available. As a follow up to our previous letter, we are providing an updated listing of Spearhead Job Costs and Payments to date, as of March 30, 2020. Additionally, we have included a Certificate of Substantial Completion and ask that our retainage be reduced in order to bill for March expenses against available funds. As a reminder, the joint payments to the Unions covered the payroll period ending March 1 st . The Carpenters and Lathers signed the Joint Check Agreements , received payments and provided Letters of Good Standing through the end of February. The Finishers (DC 9) have yet to sign the Joint Check Agreement and do not appear to be willing to sign despite repeated calls, emails and explanations. We ask that Skanska transfer those funds to Spearhead so that we can make the February payment directly to DC 9. Lastly, we are providing additional costs incurred during the month of March, which include payroll, fringe, materials and equipment costs. The reduced retainage will help with some, but not all job expenses for the month of March. We appreciate your attention and any efforts to expedite this matter. Sincerely,
