Spearhead has not filed a claim to recover its losses; rather, Spearhead simply requested a meeting to discuss an equitable adjustment to its contract. I cannot emphasize enough that Spearhead is on the verge of bankruptcy, as a result of failure by SWJV to pay these actual costs incurred by Spearhead. As indicated at the outset of this letter, Spearhead needs release of our retainage and the straightforward additional costs on this project for a total of $409,440, in addition to a meeting to discuss the balance of our damages.
