Dear Brian:

In response to your letter, dated November 4, 2019, the statements regarding Project Schedule and Verbal Direction are neither valid, nor sound.

Easily Resolved The repeated requests for a Project Schedule are easily satisfied by simply providing a current schedule. Alternatively, SWJV could just as easily confirm in writing that there have been no changes to the schedule since the June 2019 version that you reference. Contract Exhibit D The contract duration for Spearhead to install GFRG/C is six (6) months. However, Spearhead was to start installation in May 2019 based on Contract Exhibit D. However, SWJV would not allow delivery of materials to the job site until October 18, 2019. Is SWJV indicating that Spearhead's end date for GFRG/C installation is actually March 2019? Clearly, Exhibit D is of little value for planning purposes, which is why Spearhead continues to request a Project Schedule.

Brian, your refusal to provide a subcontractor working on your behalf with a current, useful schedule is concerning.

Verbal Direction Spearhead will only perform out of scope work with a Written Directive.

As previously stated in writing and in person, we have exhausted this discussion. We disagree that our assertions are unsubstantiated and have meticulous records to that end.
