DRUG & ALCOHOL TESTING POLICY – STATE SUPPLEMENT FOR MINNESOTA

This Policy Supplement applies only to those Associates working in the state of Minnesota, excluding DOT- Drivers . Where state law requires greater or separate requirements than outlined in the Company’s Drug & Alcohol Testing Policy, this Supplement will be followed in accordance with the Minnesota Drug and Alcohol Testing in the Workplace Act . Posting Requirement: Notice of Company policy and this Supplement will be posted in a visible location where all other workplace posters are displayed at the worksite location. Advance Written Notice: Written notice of this policy will be provided to each Associate. Conditional Offers will also receive written notice of the policy upon hire and before testing. Copies of Policy Available: Copies of the policy will be made available by management during regular business hours. Conditional Offers and Associates may receive a copy the policy by requesting from management during normal business hours. Right to Refuse: Each Conditional Offer and Associate has the right to refuse any requested test. But, be aware that disciplinary action may occur if one refuses to test. Each Conditional Offer and Associate must acknowledge being provided the policy or given access to the policy. Collection Sites: All drug and alcohol test samples will be collected according to state required procedures and analyzed by approved laboratories using authorized approved test methods and technology. Post-Test Procedures: Within 3 working days any Conditional Offer or Associate will be notified in writing of their test result, their right to request a retest and the timing of that right, the right to explain the result and the limitation on “first-time-positive” discipline and what their options are. Consequences: No Associate testing positive the first time may be discharged unless that Associate refuses or fails to complete counseling. Access to Records: All test related records (including test result) will be made available for copying to Conditional Offer and Associate upon request.

Medical Marijuana Be advised that even though the medical use of marijuana has been authorized in this state, employers have not been required to accommodate its use in the workplace. The Company will abide by all related state laws.

All Minnesota Associates must be given a copy of the Company’s Drug & Alcohol Testing policy along with this State Supplement and sign the Drug & Alcohol Testing Consent Form.
