DRUG & ALCOHOL TESTING POLICY – STATE SUPPLEMENT FOR MONTANA

This Policy Supplement applies only to those Associates working in the state of Montana, excluding DOT- Drivers . Where state law requires greater or separate requirements than outlined in the Company’s Drug & Alcohol Testing Policy, this Supplement will be followed in accordance with the Montana Workforce Drug and Alcohol Testing Act . Testing Limitations: All testing conducted will be in compliance with the federal Department of Transportation “DOT” rules and is limited only to those Associates engaged in the performance, supervision, or management of work in a: 1. hazardous work environment (as defined below); 2. security position; or 3. position: a. affecting public safety or public health; b. in which driving a motor vehicle is necessary for any part of the individual's work duties; or c. involving a fiduciary responsibility for an employer. "Hazardous work environment" includes but is not limited to positions: (1) for which controlled substance and alcohol testing is mandated by federal law, such as aviation, commercial motor carrier, railroad, pipeline, and commercial marine Associates; (2) that involve the operation of or work in proximity to construction equipment, industrial machinery, or mining activities; or (3) that involve handling or proximity to flammable materials, explosives, toxic chemicals, or similar substances. Sample for testing includes urine, breath or oral fluid. Reasonable Suspicion Testing: If there is reason to suspect that an Associate’s faculties are impaired on the job as a result of controlled substance or alcohol use, the Associate may be tested. Post-Incident Testing: Any Associate involved in a workplace accident resulting in a death, injury or property damage in excess of $1,500, and there is reason to believe the Associate may have caused or contributed to the accident will be subject to drug and/or alcohol testing. Post-Test Procedures: The Company will provide an Associate tested with a copy of the test report. Retest: The Company will also provide, at the Associate’s request a test of the “split sample” by an independent laboratory selected by the Associate. The Company will pay for the test if the result is negative (or not found present) and the Associate will pay if the split sample result is positive (or found present). Rebuttal: The Associate will be provided an opportunity to rebut any test result and advised of the process for initiating that rebuttal opportunity. (e.g. who to call/notify-phone number, in writing, etc.) Confidentiality: All information related to a drug or alcohol test, including interviews, reports, statements, memoranda and test results are considered confidential and will be treated as such. Only authorized individuals will have access to such materials. Required Training: Supervisors will receive appropriate training in accordance with federal DOT requirements.
