DRUG & ALCOHOL TESTING POLICY – STATE SUPPLEMENT FOR VERMONT

This Policy Supplement applies only to those Associates working in the state of Vermont, excluding DOT- Drivers . Where state law requires greater or separate requirements than outlined in the Company’s Drug & Alcohol Testing Policy, this Supplement will be followed in accordance with Vermont drug and alcohol testing law and regulations. Advance Written Notice: At the time of application each Conditional Offer will be informed in writing of the Company’s intent to require a drug test. The Conditional Offer will also be told that the list of drugs to be tested can be found in the Company policy and advised that no therapeutic levels of prescribed medicines will be reported to the Company. Testing Limitation: Testing may only occur when there is probable cause to believe that the Associate is using or under the influence of a prohibited substance while on the job. Post-Test Procedures: All Conditional Offers and Associates will be provided with notice of test results and their rights to rebut or explain and their right to independently analyze the sample. The Company will provide the Associate (not the Conditional Offer ) with the opportunity, at Company expense , to independently analyze the sample. The Associate must advise the Company of this choice. Consequences: Any Associate testing positive the first time will not be terminated and will be referred for assistance to the Company’s Employee Assistance Program. Anyone refusing to participate in counseling, failing to successfully complete counseling or with a second positive test result will be terminated. Suspension: Anyone agreeing to counseling may be suspended for the period of counseling, but in no event longer than 3 months Employee Assistance : Any Associate who needs assistance with a drug or alcohol issue should contact the Human Services office.

Medical Marijuana Be advised that even though the medical use of marijuana has been authorized in this state, employers have not been required to accommodate its use in the workplace. The Company will abide by all related state laws.

All Vermont Associates must be given a copy of the Company’s Drug & Alcohol Testing policy along with this State Supplement and sign the Drug & Alcohol Testing Consent Form.
