DRUG & ALCOHOL TESTING POLICY – STATE SUPPLEMENT FOR MARYLAND

This Policy Supplement applies only to those Associates working in the state of Maryland, excluding DOT- Drivers . Where state law requires greater or separate requirements than outlined in the Company’s Drug & Alcohol Testing Policy, this Supplement will be followed in accordance with the Maryland Health-General Code Ann. §17-214 et seq . and Admin. Code §10.10.10.01 et seq . Testing Limitations: NO BREATH-ALCOHOL TESTING ALLOWED. Otherwise all collection and laboratory analysis will be in accordance with Maryland state regulations. The permitted type of specimen obtained for testing varies between Conditional Offer and current Associate. See table below. Type of Specimen Allowed Conditional Offer Current Associate

Collection Sites: At the time of testing the person being tested will be informed of the name and address of the laboratory that will test the specimen. Post-Test Procedure: Within 7 days of receiving any positive test result the Company will by hand or certified mail deliver to either a Conditional Offer or Associate the following: 1. A copy of the laboratory test indicating the test results; 2. A copy or written summary of the employer's policy covering an Associate or Conditional Offer with a confirmed positive test result; 3. If applicable, written notice of the employer's intent to take disciplinary action, terminate employment, or change the conditions of continued employment; and 4. A statement or copy of the provisions set forth in §B of this regulation permitting a Conditional Offer , Associate, or contractor to request independent testing of the same sample for verification of the test result. Retest Procedure: A Conditional Offer or Associate who is required to submit to an alcohol or drug test may request that an independent test be performed on the same specimen in a confirmation test by: 1. Notifying the Company and the laboratory that performed the test of the challenge to that test result; and 2. Requesting that laboratory to submit a sufficient portion of the original specimen to a different laboratory chosen by the Conditional Offer or Associate and properly licensed to perform alcohol or controlled dangerous substances testing. 3. The Conditional Offer or Associate must select an independent testing laboratory that will perform the independent test using detection levels for alcohol or controlled dangerous substances equal to or lower than those provided by the laboratory that performed the initial confirmation test. 4. The Conditional Offer or Associate will pay all costs of independent testing including any costs associated with specimen handling and transport. Medical Marijuana
