THE HUMAN RIGHTS OF MIGRANT WORKERS IN THE CONTEXT OF CONTEMPORARY INTERNATIONAL MIGRATION Diana Cucos

Abstract: This article focuses upon the legal situation of migrant workers in relation to their enjoyment of human rights. It commences from the contemporary situation of the increasingly global and frequent character of human mobility – rising numbers of migrants whose migration is often irregular – combined with evidence of human rights abuse during the migration cycle. It then indicates that this has led to migrants being identified as a vulnerable group and brought within the mainstream of human rights protection. Further, it emphasizes that, under the principle of universality of human rights, all migrants, irrespective of their status, are protected by the core human rights treaties. In addition, the international labour standards protect basic worker rights, enhance workers’ job security, and improve their term of employment on a global scale. In addition, migrant workers can also enjoy the protection of their state of nationality by means of diplomatic protection and consular assistance. It concludes by indicating the continued necessity for migrant workers, irrespective of their status, to be accorded the full and effective enjoyment of human rights protection. Resumé : Článek se zaměřuje na právní postavení migrujících pracovníků ve vztahu k uplat- ňování jejich lidských práv. Vychází ze současné situace stále více se globalizující povahy lidské mobility – rostoucího počtu migrantů, jejichž migrace je často nelegální – v kombi- naci s porušování lidských práv v průběhu migrace. Dále článek naznačuje, že byli migranti identifikováni jako zranitelná skupina a dostali se tak do hlavního proudu ochrany lidských práv. Dále článek zdůrazňuje, že podle zásady univerzality lidských práv jsou všichni mi- granti, bez ohledu na jejich postavení, chráněni základními smlouvami o lidských právech. Mezinárodní pracovní standardy navíc chrání základní práva pracovníků, zvyšují jistotu zaměstnání a zlepšují pracovní podmínky v celosvětovém měřítku. Kromě toho mohou migrující pracovníci požívat ochrany svého státu prostřednictvím diplomatické ochrany a konzulární pomoci. Na závěr článek uvádí, že je nutné, aby migrujícím pracovníkům bylo bez ohledu na jejich postavení přiznáno plné a účinné využívání ochrany lidských práv.
