HUMAN RIGHTS OF OLDER PERSONS IN INTERNATIONAL LAW Veronika Bílková 1

Abstract: The article concentrates on the protection of human rights of older persons within the UN human rights system. It first describes the legal framework applicable to older persons at the universal level. It gives an overview of the main sources making up this framework and it considers how older persons are, or should be, defined within the UN human rights system. In the subsequent step, the article identifies the main human rights problems faced by older persons and reveals how these problems are (or are not) addressed under the current regulation. The final section provides an assessment of the regulation, concluding with the recommendation to seriously ponder the possibility of adopting a new human rights treaty that would deal specifically with the human rights of older persons. In addition to clarifying how the general human rights standards should be applied to grant efficient protection to older persons, such an instrument would also clearly manifest that older persons have the right to enjoy human rights just as any other vulnerable persons or, in fact, as any other human beings. Resumé: Článek se zaměřuje na ochranu lidských práv starších osob v rámci lidskoprávního systému OSN. První část se věnuje právnímu rámci úpravy, který existuje na univerzální úrovni. Poskytuje přehled hlavních pramenů, jež tento rámec tvoří, a zamýšlí se nad tím, jak jsou, nebo by měly být, starší osoby definovány v lidskoprávním systému OSN. V další části článek identifikuje hlavní lidskoprávní problémy, jimž starší lidé čelí, a ukazuje, jak na tyto problémy reaguje, nebo naopak nereaguje, současná právní úprava. Poslední část článku nabízí zhodnocení této úpravy a doporučuje zvážit možnost přijetí nové lidskoprávní smlouvy, který by se zaměřila specificky na starší osoby. Tato smlouva by vyjasnila, jak by se obecné standardy lidských práv měly aplikovat ve zvláštním kontextu ochrany starších osob, a dala by jasně najevo, že starší osoby mají práv požívat svých lidských práv stejně jako jiné zranitelné osoby, resp. stejně jako všichni další lidé. JUDr. PhDr. Veronika Bílková, Ph.D., E.MA, works as the head of the Centre for International Law at the Institute of International Relations in Prague and as an associate professor in international law at the Faculty of Law of Charles University. She graduated from the Law and Philosophical Faculties of Charles University and she is a holder of the European Master’s Degree in Human Rights and Democratisation and of the Diploma in International Law awarded by the University of Cambridge. She is the vice- president of the European Commission for Democracy Through Law (Venice Commission) and the Secretary-General of the European Society of International Law (ESIL). She focuses on international law and international relations and has published extensively in these areas.
