KATEŘINA ŠIMÁČKOVÁ CYIL 10 (2019) THE RIGHTS OF THE ELDERLY IN THE CASE-LAW OF THE CONSTITUTIONAL COURT OF THE CZECH REPUBLIC FROM THE PERSPECTIVE OF OLD-AGE PENSIONS Kateřina Šimáčková* Abstract: The article describes the case-law of the Constitutional Court of the Czech Republic, dealing with the issues of the right to social security in old age (old-age pensions), that means a key topic related to the rights of the elderly. The rights of the elderly are generally not emphasised in the case-law of the Constitutional Court, but the Constitutional Court repeatedly gives its opinions within the review of the constitutional conformity of laws governing the issue of old-age pensions and the taxation thereof. In its introduction, this article defines the topic of the right to social security in old age as one of the important rights of the elderly; then, the right to social security in old age is described here as one of the social rights guaranteed in the constitutional order of the Czech Republic, including the debate on the justiciability of social rights. The basic part of the article follows, describing individual decisions of the Constitutional Court, including the critical comments by the professional community and the dissenting judges. The article is concluded by reflection on the future trends of social security in old age and its judicial protection. Resumé: Článek popisuje judikaturu Ústavního soudu České republiky, zabývající se otázka- mi práva na sociální zabezpečení ve stáří (starobních důchodů), tedy klíčovou tématikou práv starších osob. Práva starších osob obecně nejsou v judikatuře ÚS akcentována, avšak právě k tématice přezkumu ústavnosti zákonů upravujících problematiku starobních důchodů či jejich zdanění se ÚS opakovaně vyslovuje. Na úvod článek vymezuje téma práva na sociální zabezpečení ve stáří jako jedno z důležitých práv starších osob, dále pokračuje popis práva na sociální zabezpečení ve stáří jako jednoho ze sociálních práv zaručených v ústavním pořád- ku České republiky, a to včetně debaty o justiciabilitě (judikovatelnosti) sociálních práv. Poté pokračuje základní část článku, popisující jednotlivá rozhodnutí Ústavního soudu ČR včetně jejich kritiky ze strany odborné veřejnosti či soudců s odlišnými stanovisky. Závěrem pak je vedena úvaha o budoucích trendech sociálního zabezpečení ve stáří a jeho soudní ochrany. Key words: older persons, justiciability of social rights, old-age pensions. About the Author: JUDr. Kateřina Šimáčková , PhD., is a judge at the Constitutional Court of the Czech Republic. In 1988 she graduated from the Faculty of Law of Masaryk University in Brno. Between 1994 and 2009, she was an attorney-at-law and later became a judge at the Supreme Administrative Court. For the period 2008 to 2012, she was appointed by the EU Council as a member of the Committee on the Selection of Judges of the EU Civil Service Tribunal. Since 2010 she has been a substitute member of the European Commission for Democracy through Law (Venice Commission) for the Czech Republic. She is a member of the Scientific Board of the Faculty of Law at Charles University in Prague and Ad hoc Judge at the European Court of Human Rights.
