FACULTY/TEACHER EMPLOYMENT

ACADEMIC YEAR

This Faculty/Teacher Employment Contract, made and entered into this day, by and between the President of the East Central Community College (ECCC) District, hereinafter called “the College” and ______, herein after called “ the Employee” witnesseth: WHEREAS, the Employee has been duly selected and approved, in the manner required by law, for the position of _____________ for the academic year of ____________; and WHEREAS, the effective term of employment of the Employee shall begin on _______ and shall end on ____________; and WHEREAS , the total annual base salary to be paid to the Employee for said services for the term of employment described in this employment contract shall be _______________ and said compensation and benefits shall be distributed as described in the ECCC Policies and Procedures Manual with the first such payment to be made on the last working day of the calendar month of ________ and year of ________ and the remaining payments to be made on the last working day of each month thereafter, until all such payments have been made; and WHEREAS, the Employee desires to enter into this contract with the College, evidencing the terms and conditions of said employment; now THEREFORE : In and for the mutual considerations hereinafter expressed and subject to the terms and conditions of employment contained and/or referenced herein, it is hereby agreed and stipulated as follows: o The Employee accepts employment as tendered by the Board of Trustees and the President of the East Central Community College (ECCC) District according to the terms set forth in this employment contract. Faculty/teachers will not be employed as stated in Section 37-29-63, Mississippi Code of 1972, until recommended by the President and approved by the Board of Trustees.

o This contract is for employment by the ECCC District. The Employee agrees and understands that he/she may be reassigned at any time during the effective term of this contract to any other position and/or other location as required for the operation of the College. o The Employee agrees to accept such additional assignments in classroom work that may be made from time to time by the President and/or his designee and also agrees to accept such additional assignments as may be made in extracurricular activities and any other assignment(s) that may be given the Employee for the best interest of the College. o The Employee accepts said employment and obligates himself/herself to satisfactorily perform his/her assigned duties as required by law and by the College; to conform to professional standards as set forth by the ECCC District; to work in harmony with other employees of the College; and to abide by all policies and procedures of the ECCC District as set forth in the Policies and Procedures Manual. Further, the Employee agrees to participate in orientation/registration dates as well as commencement exercises that may fall outside the term of employment of the Employee. o The Employee understands that this employment contract and any compensation provided for herein shall be dependent upon the continuing availability of applicable State, Federal, and/or Local Funding. In connection therewith, any and all compensation contained within this contract may be adjusted on a dollar or percentage basis if applicable funds are reduced or eliminated, if student enrollment is reduced, and/or if the Board of Trustees declares a financial exigency. This position may be terminated at any time due to lack of applicable funding and/or loss of student enrollment. o It is further agreed that the Employee’s services may be terminated at any time for the following reason(s): a. Financial exigencies as declared by the Board of Trustees; b. Termination or reduction of programs as approved by the Board of Trustees; c. Loss of student enrollment; d. Malfeasance, inefficiency, incompetence, insubordination, or contumacious conduct; e. Breach of the employment contract or the college’s policies, rules, and/or regulations by the employee; or f. For other good cause. In the event the Employee violates the terms and conditions of this employment contract, the College shall then fix the time and conditions of termination. o In the event College housing is required of the Employee during the effective term of this employment contract, then the Employee shall occupy the designated college housing during the term of this employment contract and the Employee agrees to vacate said housing upon termination of this contract. The Employee acknowledges that he/she has read and understands all provisions of this Faculty/Teacher Employment Contract including its Expressed Terms and Conditions set forth above and agrees to abide by all provisions as set forth herein.
