Repatriation of Irish prisoners under the provisions of the Transfer Convention will undoubtedly promote and encourage rehabilitation of offenders and alleviate the burden of financial and physical hardship and stress borne by their families here. Though the Minister for Justice preserves her discretion in the Act to grant or refuse an application or her consent to an application, as the case may be, there is a commitment to transparency and equity in the operation of the Convention and a decision to refuse her consent must be notified in writing to the affected party. Subject to limitations referred to above, the Minister must specify grounds for any refusal. Section I 1 of the Act requires the Minister to make a report to each House of the Oireachtas on the operation of the Act during the preceding year. The Report must be furnished within four months after the end of each year from 31 December. 1995. The Report must include information in relation to each implication made during the year under the Act. The ratification of the Transfer Convention should go some way towards alleviating the growing sense of despair and isolation so keenly fell by this often forgotten constituency ot the Irish Diaspora.
