Cancellation of Membership – Robert Bruce Cheadle, Victoria, BC In the January/February 2011 edition of Innovation , we reported that Robert Bruce Cheadle was served with a Notice of Inquiry for breaching an undertaking with the Association and that in lieu of proceeding to an inquiry, Mr Cheadle signed a Consent Order admitting unprofessional conduct and agreeing that commencing October 31, 2010, his membership would be suspended for a minimum period of six months. Following his suspension, Mr Cheadle’s practice was to be restricted. In addition, Mr Cheadle was to have independent peer reviews conducted of certain past building envelope projects at his own cost and pay the Association’s legal and investigation costs, failing which his suspension would continue. Mr Cheadle failed to comply with terms of the Consent Order and the matter was referred back to the Discipline Committee Panel for consideration of further penalties, in accordance with subsection 34(1) of the Engineers and Geoscientists Act . Upon review of submissions from Mr Cheadle, the Panel agreed that the conditions set out in the Order have not been met and ordered that Mr Cheadle’s membership in the Association is cancelled effective February 20, 2012. Consent Order – Phillip John Read PEng, Pemberton, BC A complaint was made to the Association that Mr Read’s design and field reviews for a Type 3 sewerage system for a residential property in Nanaimo, BC, filed with the Vancouver Island Health Authority, did not meet the requirements of the BC Sewerage System Regulation. The complaint was investigated by the designated reviewer and sent to the Investigation Committee, which recommended that a discipline inquiry be held. In lieu of proceeding to an inquiry, Mr Read admitted the deficiencies in his work set out in the Notice of Inquiry and accepted as his penalty: 1. A reprimand; 2. Payment to the Association of its legal costs and disbursements, up to a maximum of $5,000 on or before May 23, 2012; 3. That he undergo a general and, if necessary, technical practice review at his own expense; and 4. That for new and existing sewerage projects, Mr Read have his services relating to wastewater treatment and disposal systems peer reviewed at his own expense for a period of at least 12 months by a professional engineer approved by the Registrar of the Association; and 5. That should Mr Read fail to comply with any condition of the Order, he be suspended until every default has been remedied.
