A Year of New Challenges and New Achievements R E C A P P I N G 2 0 1 7 1

With a busy legislative season, new technologies making headlines, and an expectation-breaking Auto Show, GNYADA’s 108th-year comes to a close. As 2017 recedes in the rearview, let’s reflect on some of the Association’s most meaningful moments from the past year. Legislative Successes In June, the State Legislature overwhelmingly passed a bill for which the Association strongly fought, to impose necessary regulations on auto brokers and leasing companies. This momentous legislation passed because of regular meetings with the bill’s sponsors and the concerted efforts of area new car dealers who reached out to their representatives for support. This big legislative win capped off a highly productive Legislative Session, in which GNYADA halted Tesla’s push to open more non- franchised stores, introduced legislation to ensure dealers are reimbursed for the cost of storing vehicles with open recalls, and moved forward on many other priority issues. The Association's 2017 Economic Impact Report – which is distributed to state and federal policy makers and to regional media sources to further the Association’s political agenda – revealed that franchised new car dealerships were responsible for more than 68,000 jobs and $48.5 billion in total economic activity spread throughout Metro New York. This Report is a powerful tool to prove to legislators why our region’s franchised new car dealers must have their businesses protected. GNYADA Publishes 2017 Economic Impact Study

DCA Withdrew 200+ Dealer Subpoenas After working closely with the NYC Council on legislation to address concerns around the sale of used cars with open recalls, the DCA agreed to GNYADA’s request to drop roughly 200 subpoenas that the agency issued to City dealers three years prior. GNYADA Works with Gov to Help New York “Go Green” The Association lobbied to include $55 million in the New York State budget and create the “Drive Clean” EV rebate program, which was launched in March. Since then, franchised new car dealers have used these incentives to drive more than 4,123 electric vehicle sales in our region.

125K Raised at Charity Golf Outing At the Annual Charity Golf Outing, the Association raised a record $125,000 to support automotive education. On the day of the Outing, GNYADA also distributed $22,000 in educational scholarships, including four $5,000 scholarships to U.S. military veterans enrolled in Lincoln Technical Institute’s technician training program. 100K Donated in Disaster Relief In September, the GNYADA Board approved $50,000 contributions to both NADA’s Emergency Relief Fund and the American Red Cross to aid the recovery efforts after Hurricanes Harvey and Irma caused enormous damage to facilities and homes throughout the south and southeastern United States.

NYIAS Defied Expectations Amid rumors of soft attendance and waning enthusiasm, the 2017 New York Auto Show surpassed industry predictions in terms of ticket sales, media coverage, and vehicle debuts. Governor Cuomo joined the Association’s Board onstage for the grand opening, highlighting two weeks of highly-anticipated model unveilings, industry events, and special conferences that explored emerging developments in automotive retail.

2 Year-End Compliance Reminders & Deadlines To ensure members don’t lose track of important deadlines and compliance requirements effective in late 2017 and early 2018, the Association has put together this list of helpful year-end reminders.

Vaping Banned in NYS Workplaces As of NOVEMBER 22, 2017 , dealers must prohibit the use of electronic cigarettes wherever cigarettes and other tradi- tional tobacco products are already banned. For signage purposes, the international “No Smoking” symbol is suffi- cient to alert people that e-cigarettes are banned in the dealership. NYC “Fair Workweek” Laws In Effect As of NOVEMBER 26, 2017 , retail employers in New York City must now post employees’ schedules 72 hours before the start of the shift. NYC dealers cannot change workers’ shifts with less than 72 hours’ notice, nor can they require employees to be “on call” without consent.

New York State Paid Family Leave Goes into Effect Starting JANUARY 1, 2018 , employees in New York State may start taking paid time off under the state's Paid Family Leave Benefits Law. Premiums are fully funded through employee payroll deductions. In 2018, employees will be eligible for eight weeks of paid leave at 50% of their average weekly wage, not to exceed 50% of the State’s average weekly wage. The number of paid leave weeks and salary percentage employees can receive will increase each year until 2021. To learn more about PFL requirements, see page 5. Updated Used Car Buyers Guides Dealers must fully transition to the updated version of the FTC-mandated used car Buyers Guide by JANUARY 28, 2018 . Revised guides, which prompt customers to check safercar.gov for possible open recalls and direct Spanish- speaking customers to request a Spanish version of the guide, can be purchased from the Association. Employee/Worker Tax Forms W-2 and 1099-MISC forms must be distributed to employees by JANUARY 31, 2018 . This is also the deadline for employers to submit W-2s to the Social Security Administration. Notify Cash-Customers of 8300 Form-Filing By JANUARY 31, 2018 , all customers from 2017 for whom the dealership filed Form 8300 (Report of Cash Payments over $10,000) must be notified, on dealership letterhead, that the IRS was made aware of their transaction. 3 Dealers Employ Veteran Scholarship Winners

Thirteen-year Army veteran Chung Lee, a Medal for Valor winner who also received a scholarship at the Outing, currently works at Bayside Chrysler Jeep Dodge. Chung is slated to graduate LTI in January. Henry Bastidas, a Marine combat vet who worked in the motor pool to prepare vehicles for missions in Afghanistan and Iraq, is working at Jaguar Freeport. Henry graduated LTI in October. “Helping our retired service-members find rewarding employment in their civilian lives, while also helping our members hire dedicated, well-trained technicians, is a proud win-win for GNYADA,” said GNYADA President Mark Schienberg. “Not only does our scholarship program offer much needed financial help to students training to join our industry, it also creates opportunities for our members to get a sense of them as potential dealership personnel.” n n

GNYADA awarded educational scholarships to several military veterans at the Association’s Charity Golf Outing. We are happy to report three of the students found jobs as techs at franchised dealerships in the metro area. Jonathan Laufer, a petroleum engineer who led a team of diesel techs during his service as a Marine Sergeant, currently works at Brown's Jeep Chrysler Dodge n A GNYADA dealership employee was recently ticketed for driving a dealer- owned vehicle with dealer plates. The violation, cited by the Nassau County police officer who issued the ticket, was Improper Use of Dealer Plates . After consulting with GNYADA, the dealership, Karp Automotive in Rockville Centre, contested this ticket and presented supporting documenta- tion, including: a letter from the New York State n

charge to a lesser non-moving violation. Karp Auto declined this and opted to go before a judge who ultimately dismissed the case. At GNYADA’s urging, the Department of Motor Vehicles reissued a letter, including the name of the Acting DMV Commissioner, which informs law enforcement that personal use of dealer demos with plates is permissible.

5 Dealer Obligations under Paid Family Leave Starting on January 1, 2018, all

Benefits must also continue during this time, as long as the employee continues to pay any share (s)he was paying prior to going on leave. Leave can be used for the birth, adoption, or foster care of a new child; also to care for a seriously ill family member; or when a family member is called to active military service. PFL cannot be used for the employee’s own health condition.

The New York International Automobile Show won several prestigious awards including “Best of Show” at the 2017 International Association of Exhibitions and Events’ (IAEE) Art of the Show competition in the Social Media Campaign category. Winners were selected for their creative use of essential marketing elements to promote events. “It is an incredible honor to be recognized by the IAEE in the hotly contested social media category,” said John LaSorsa, Chairman of the New

The Occupational Safety and Health Administration (OSHA) requires dealers with ten or more employees to keep detailed logs of work-related injuries and illnesses and post incident summary forms. Logs must be displayed in dealerships annually between February and April. A work-related injury or illness would include — but is not exclusive to — any abnormal health issue that is caused or aggravated by on-the-job events or exposures. To meet OSHA’s severity threshold for reportable incidents, the worker(s) must be affected in one of the following ways: death unconsciousness missed workdays restricted work activity or job transfer medical treatment beyond first aid n n n n n

The following OSHA forms must be completed annually: Form 300 (Log of Work-Related Injuries and Illnesses) is the primary document used to classify work- related injuries and illnesses and the severity of each. This electronic form allows dealerships to record incidents that occur in a given calendar year. (If you own multiple dealerships, each will require its own Form 300.) Form 301 (Injuries and Illnesses Incident Reporting) allows dealers to document the details of any individual incident. Dealers should complete this form within seven calendar days of learning about a work-related injury/illness. Form 300A is the hardcopy version of Form 300, which must be

The panel was moderated by Adam Armbruster, a partner with ESA & Company, an organization that focuses on retail advertising strategies. Certilman and Schienberg outlined where dealers are spending their budgets, how they measure results, and the current challenges in the industry. They also took questions from the audience, which consisted of digital sellers and sales managers from the broadcasting industry. NAB is the premier advocacy association for America’s broadcasters, advancing the interests of radio and TV professionals in legislative, regulatory, and public affairs. “Our goal is a healthy and productive dialogue between broadcasters using digital tools and the local auto dealership community,” said Richard Novik, NAB’s Senior Vice President of Member Services.

Seeing this provision added to the Senate bill, also included in the House version, was NADA’s top priority in recent weeks. Without this amendment, dealers’ ability to deduct 100% of business interest, including floor plan interest, would reduce to 30% of adjusted

of all Karp Auto dealerships since 1983. In preparation for this milestone, the Karps pledged $60 for every car sold at the Volvo location in 2017, with the goal of donating $50,000 to Memorial Sloan Kettering Breast Cancer Research and $10,000 to the Rockville Centre Community Fund. Rather than wait, the Karps presented these charities with checks for half of the pledged amounts earlier in the year, so funds could be put to use right away. GNYADA congratulates David and Daniel on achieving this impressive milestone and for their dedication to customer service and community support.

11 In October, New York State began issuing forms allowing individuals to apply for the new REAL ID licenses. As customers are already presenting these documents at area dealerships, dealers should be aware that all forms of the new ID are acceptable for the full 6 points of identification to register and title a vehicle. There are three different levels of new NYS IDs being issued: the standard license; the new REAL ID license; and the enhanced license. Get Familiar with the State’s New “REAL ID”

12 IRS Form 8300 Letters Due January 31 Federal law requires dealers to file Form 8300 with the IRS whenever a customer makes a transaction of $10,000 or more in cash or cash equivalents. Dealers must also notify the customer in writing, no later than January 31 of the following year , that a Form 8300 was filed for their transaction. One copy of the completed Form 8300, along with a Date Dear Customer:

We are required by the Internal Revenue Service (IRS) to report all transactions involving payments of more than $10,000 in cash (26 USC6060(I)). We filed Form 8300 with the IRS on (date) 2017, indicating that you paid us $(amount) in connection with your purchase of a (year, make, model, VIN).

While there is no legally required length of time to retain these forms, the Association suggests that five years is appropriate. Possible fines/penalties Fines and penalties can vary depending on the offense. If companies willfully fail to file the proper form, fines of up to $500,000 and up to 5 years imprisonment, or both, may be imposed. Dealers are advised to have a written policy in place and comply with the rule by filing the proper forms on time.

Helms Bros Gives Technical High School Students a Dealership Walkthrough 13

In an effort to attract young talent to the automotive retail industry, GNYADA has begun organizing opportunities for local technical high school students to experience the inner workings of new car dealerships. Most recently, students from Thomas Edison Technical Education High School were taken on a full tour of Helms Bros’ facilities on Northern Boulevard, exploring each department and learning about the numerous opportunities available. Helms Bros General Manager, GNYADA Education Committee Chair, Suzanne Cochrane, welcomed the visiting eleventh- and twelfth- graders. She spoke about the importance of a positive outlook and a strong work ethic.“You can teach almost any job skill but the right attitude is everything. Attitude increases your altitude,” said Cochrane. The tour included stops at Helms Bros’ Mercedes-Benz showroom, as well as the dealership’s DMV desk, sales offices, payroll department, and service center. Throughout the morning, students were highly attentive and engaged, eagerly sharing thoughts and questions with each team they met.

The student group featured a mix of young men and women, prompting Cochrane to highlight her own dealership as an indicator of the opportunities open to women in the industry. “Our goal with these visits is to open young people's eyes to the world of diverse job opportunities and good salaries they’ll find at a franchised new car dealership,” said GNYADA Vice President of Education Eddie Gazzillo. “We’re very grateful that GNYADA members, like Helms Bros, understand the importance of

showing these eager minds what working in a dealership is all about.” The Association thanks Suzanne Cochrane and the staff at Helms Bros for volunteering their dealership to provide this rewarding and instructive experience to local automotive students. This visit was also covered in NADA’s November 20th “Headlines” newsletter, under the title “Promoting Industry Careers, NYC Car Dealers Open Their Doors to Local Students.”

2018 Fuel Economy Guide Now Available 14

The Guide provides car buyers with detailed fuel economy estimates for 2018 light-duty vehicles and explains the benefits of fuel-efficient vehicles. EPA regulations require dealers to display the Guide prominently at each location where new automobiles are offered for sale and to make it available to the public at no charge.

The Association made several important additions to its staff in 2017 to fill open positions, streamline office operations, and enhance the services offered to members. We’re pleased to officially report our latest additions:

Kelsey Hering is the Administrative Assistant for GNYADA’s Dealer Services team. Many of our members regularly reach out to Kelsey for questions about ERP membership, seminar registration, getting in touch with legislators, and much more.

Isabel Goldberg joined GNYADA as Executive Assistant to Mark Schienberg. Isabel worked as a consultant at ONE Music Group immediately prior to her role here. She also spent ten years as Executive Assistant to the New York Mets’ General Council.

Aaron Brown joined GNYADA as a Field Service Rep. Aaron came to the Association from Cintas, where his sales role brought him to many local companies, including Helms Bros and the East Hills Auto Group. Members, particularly on Long Island, will see Aaron at their facilities as he makes his in-person visits.

Frida Machado-LaRose came on board as Office Administrator for Association headquarters. Frida’s office management experience includes stints at McDonald’s, Pfizer, Smith Barney & Co., and Chemical Securities. With GNYADA, Frida will supervise administrative staff, execute HR functions, and lead other office projects.

16 Rose Macleod Retires from GNYADA

Rose was promoted to Vice President in October of 2009. She has since been a major force in growing GNYADA’s staff, upgrading systems, and renovating physical facilities. “Anyone who’s ever dealt with GNYADA knows Rose,” said GNYADA Director and former Chairman of the Board, Lou Giordano. “In addition to being one of the nicest people you could meet, she always gives timely and accurate answers to questions. Even in demanding situations, she’s never rattled or overwhelmed.” “To say we will all deeply miss Rose is a tremendous understatement,” continued Schienberg. “Everyone at the Association wishes her nothing but the absolute best as she starts an exciting new chapter of her life.”

Rose joined GNYADA on June 28th, 1999. Starting as an Executive Assistant, she was soon promoted to Office Manager, overseeing facility operations, organizing GNYADA events, managing staff, and negotiat- ing vendor contracts. Rose con- tributed significantly to some top Association initiatives, such as the Annual Meetings and Charity Golf Outings and the development of the Center for Automotive Education & Training. “Rose demonstrated incredible dedication and professionalism in service to our members,” said Association President Mark Schienberg. “She took on countless leadership roles, encompassing multi- ple GNYADA functions, and fulfilled them all with wonderful energy, dili- gence, and thoroughness.” “We thank Irwin’s family and Apple Honda for their tireless support of the Peconic Bay Medical Center. This is a reminder to all businesses, large and small, that philanthropy is a vital part of community life,” said Mr. Mitchell. Recently, four CPR training units were also donated to the PBMC in Irwin’s name, as was a $10,000 con- tribution by GNYADA. 17 L.I. Hospital Unveils Plaque in Irwin Garsten’s Memory

The Peconic Bay Medical Center’s nursing and education building now displays a glass plaque in honor of Past GNYADA Chairman Irwin Garsten, who passed away in February. Garsten, the founder of Apple Honda, dedicated much of his philanthropic efforts to benefit the medical facility, which is a key com- munity presence in the North Fork. The plaque unveiling event was attended by; Andrew J. Mitchell, President and CEO of the Peconic Medical Center; Irwin’s wife, Flora Garsten; Bill Fields, CEO of Apple Honda; and GNYADA President Mark Schienberg.

Waste Fee Reminders

Make the Most of Your GNYADA Membership As members of the Greater New York Automobile Dealers Association, dealers have access to a wealth of services and programs aimed at keeping their busi- ness operations compliant, efficient, and profitable. The Association regularly receives questions about when dealers may charge fees for environmental waste disposal. DMV permits deal- ers to charge for the disposal of waste materials, with the exception of motor oil, batteries, and tires. Any disposal charges for other waste products (antifreeze, brake fluid, sealants, etc.) must be clearly identified and itemized in all esti- mates and repair orders. Dealers may not use preprinted fees or per- centage based fees. Motor Oil: State Law prohibits deal- ers from charging for accepting waste oil. Dealers must take up to five gallons of used oil per day from an individual and must con- spicuously post a sign stating: We Accept Used Oil for Recycling at No Charge. Batteries: NY law requires retailers to accept up to two batteries per month per individual at no charge. Again, a conspicuous sign is required and must state: It is illegal to discard vehicle batteries. State law requires us to accept vehicle batteries at no charge for recycling. Tires: Dealers may not charge for accepting waste tires that are simi- lar in size and quantity to the num- ber of tires purchased by the cus- tomer. The State requires sellers of new tires to collect a $2.50 Waste Tire Fee for every new tire sold, to cover their future recycling cost. These charges must also be item- ized in all estimates and R.O.s, and an official sign must be posted. GNYADA offers required disposal signs to members, free of charge. To order, call 718.746.5900.
