THE HIGHEST AMOUNTS OF JUST SATISFACTION… THE HIGHEST AMOUNTS OF JUST SATISFACTION: AWARDS OF THE EUROPEAN COURT OF HUMAN RIGHTS TO LEGAL PERSONS

Abstract: The author offers an overview of the ten judgments of the European Court of Human Rights (hereinafter ‘the Court’), in which it awarded to legal persons the highest amounts of just satisfaction in the Court’s history. The study is focused on those compensations exceeding one million euros; the highest of the awards, in the Yukos case, is even in billions of euros. Further, the analysis of these judgments seeks to discover the common and distinct features of the awards. In addition, the author enquires into why the just satisfaction amounts honoured to legal persons are higher than those admitted to natural persons. The article also provides basic information on the compensation mechanism under the European Convention on Human Rights (hereinafter ‘the Convention’). Resumé: Autorka ve článku, nabízí přehled deseti rozsudků Evropského soudu pro lidská práva (dále jen „Soud“), ve kterých právnické osoby obdržely nejvyšší částky spravedlivého zadostiučinění v historii Soudu. Studie je zaměřena na náhrady újmy přesahující milion eur. Nejvyšší odškodné ve věci Yukos je dokonce v miliardách eur. Dále je provedena analýza těchto rozsudků s cílem odpovědět na otázku, jaké jsou společné a rozdílné rysy těchto rozsudků. Kromě toho, autorka si pokládá otázku, proč jsou částky zadostiučinění udělené právnickým osobám vyšší než ty, které Soud přiznal fyzickým osobám. Článek také poskytuje základní informace o mechanismu odškodňování na základě Evropské úmluvy o ochraně lidských práv (dále jen „Úmluva“). Alla Tymofeyeva Ph.D. works in the area of European Convention Law. Her Ph.D. was acquired in 2011 at the Law Faculty of Charles University in Prague. The title of her thesis is ‘Access to independent and impartial court as a fair trial guarantee under the European Convention on Human Rights’. In 2009 and 2014 Alla undertook traineeships at the Registry of the European Court of HumanRights in Strasbourg.
