Contractual Benefits and Obligations

The Associate’s contract continues throughout OML and AML. During OML and AML Associates are entitled to accrued holiday and Public holiday entitlement, which may be taken within 12 months of their return to work and all other benefits except remuneration (i.e. wages/salary).

Keeping in touch

The Company may make reasonable contact with the Associate from time to time during her maternity leave.

The Associate may work, and be paid, (including attending training) for up to 10 days during maternity leave without bringing her maternity leave or SMP to an end. The Associate is not obliged to undertake any such work during maternity leave. In any case, she must not work in the 2 weeks following birth. Shortly before the Associate is due to return to work, the Company may invite her to have a discussion (whether in person or by telephone) about the arrangements for her return to work.

This may include:

 updating the Associate on any changes that may have occurred

discussing any necessary training

 discussing any changes to working arrangements (for example any request to work part time)

Shared Parental Leave

Shared parental leave is a form of leave available to working parents following the birth of a child. It applies in respect of children who are expected to be born on or after the 5 April 2015.

Shared parental leave allows parents to take up to 52 weeks leave in total on birth of a child. They may be able to take this leave at the same time or at different times.

An associate might be entitled to take shared parental leave. Please see the section of this Handbook on Shared Parental Leave for further details.

Parental Leave

Parental leave entitles Associates, with one year’s continuous service to unpaid leave subject to various conditions (of up to 18 weeks) for parents of children born or adopted on or after 8 th March 2013. The leave entitlement can be taken for the purpose of caring for that child, e.g. settling the child into a new play group, at any time up to the child’s fifth birthday, or in the case of adopted children, five years from the placement or until the child reaches 18, if sooner.

For parents of disabled children (those receiving disability living allowance) the leave entitlement will continue up to the child’s 18 th birthday.
