5.1.1 Have been employed with the City of Raleigh for at least twelve months (the twelve months do not need to be consecutive). 5.1.2 Have worked at least 1,250 hours during the twelve consecutive months immediately preceding the date the leave would begin. 5.1.3 Have an employee status that is eligible for benefits. Non benefit eligible employees are not covered by this policy but are eligible for unpaid leave under the Family and Medical Leave Act if the employee otherwise meets qualifying requirements. Please refer to the Family and Medical Leave Policy for further guidance on the FMLA. 5.2 In addition, eligible employees must meet one of the following criteria: 5.2.1 Have given birth to a child. 5.2.2 Be the biological parent of a child 5.2.3 Be a recognized spouse, as defined under the Family and Medical Leave Act, of a person who has given birth to a child. 5.2.4 Have adopted a child or been placed with a foster child (in either case, the child must be age 17 or younger at the time of the PPL request). 5.2.5 Placement of a child (age 17 or younger) with the employee for whom the employee is acting “in loco parentis” as described in the Family and Medical Leave Policy. 6.1 Eligible employees will receive a maximum of eight weeks of PPL per birth, adoption or placement of a child/children in any twelve-month period. The fact that a multiple birth, adoption or placement occurs (e.g., the birth of twins or adoption of siblings) does not increase the eight week total amount of PPL granted for that event. In addition, in no case will an employee receive more than eight weeks of PPL in a rolling twelve-month period, regardless of whether more than one birth, adoption or foster care placement event occurs within that twelve-month time frame. 6.2 Each week of PPL is compensated at 100 percent of the employee’s regular, straight-time weekly pay based on their regularly scheduled work-week. PPL will be paid on regularly scheduled pay dates. At no time will an employee be allowed to earn overtime while on PPL. 6.3 Approved PPL may be taken at any time during the twelve-month period immediately following the birth, adoption or placement of a child with the employee. PPL may not be used or extended beyond this twelve-month time frame. 6.4 Employees must take approved PPL in one continuous period of leave and cannot be taken intermittently. Employees can take PPL only during the first twelve months
