emergency. The decision to and how to provide “assigned vehicles” are made by senior management. We maintain “pool vehicles” at each of our locations for use by business development professionals and managers for customer calls, travel between Company locations, etc. These vehicles must kept at the ITU AbsorbTech location at night. Each location will maintain a sign-out log to reserve and track all “pool” vehicles. Each “pool” vehicle has a clipboard for recording use information. All vehicle-related reporting must be completed. Proper checks, cleanliness and fueling procedures must be followed, as indicated. There are times when no “pool” vehicles are available. You are expected to use your own vehicle and turn in an expense report promptly. You are reimbursed for tolls, parking and mileage at the IRS approved rate. 703 Defensive Driving Responsibility A driver’s responsibility for safe driving is more than simply “not violating the law.” A defensive driver is one who commits no driving errors and makes allowances for poor traffic, road or weather conditions and the mistakes or lack of skill of others and is not brought into an accident by the unsafe actions of pedestrians or by unsafe situations as they develop. We expect all employees driving for Company business to defensively drive their vehicle.

Management, with input from vehicle operators and mechanics, is responsible for specifying vehicles that are appropriate for the task and for providing the maintenance required to keep the vehicle in good operating condition. Pre-operation training, annual reviews and periodic classroom education are provided.. Assigned and Pool Vehicle Use. Vehicle use is necessary to conduct several functions in our business, e.g. customer calls, sales calls, etc. The assignment of vehicles is to be handled as follows: When travel is a large part of a person’s job, ITU AbsorbTech may provide a vehicle for the individual to use. Preferably, the vehicle would be “dedicated” to that employee, but be based at the facility. The vehicle could be “assigned” to the employee and include work related travel and their commute to and from work. Per IRS regulations, an employee using a Company provided vehicle for commuting incurs a benefit, which is taxable. Other personal use of the vehicle is prohibited unless de minimus or

706 Motor Vehicle / P.I.T. Accident Reviews An accident involving a motor vehicle or power industrial truck (PIT) is an event that must be reviewed. This review process should address several issues: cause, preventability, and any corrective or training measures that are prudent to take. Without a thorough review, measures cannot be put in place to reduce or prevent future accidents, a stated goal of the Company. This review is best done by a small group of managers and the involved employee(s). The purpose is NOT to assign blame. Discipline, if any, is a private matter between Human Resources, the manager, and the employee. The investigation should not rely on police reports or citations. There is a large difference between “preventability” and legal “chargeability”. There are many situations where the group’s judgment are key to the result. There is no comprehensive list of poor decisions, driving mistakes or unsafe conditions – but a few examples include: In general, a preventable accident is one where the driver: • Was operating at speeds inconsistent with conditions; • Was following too closely;

Many jobs at ITU AbsorbTech require the use of a vehicle; some extensively, others only on occasion. If your position involves driving, maintenance of a valid driver’s license appropriate for the type of vehicle used on your job is required. Driving a Company vehicle without a current, valid license is grounds for immediate dismissal. If there are any changes to the status of your driver’s license or driving record (ex: warnings, citations, tickets, violations, suspension, pending actions, etc.) whether or not they occurred on-the-job, you are required to inform your Manager and HR immediately. 705 Injuries and Accidents Reporting If an employee suffers an injury or accident of any kind on Company premises or any place while on business for the Company, the employee must notify his/her Manager at once. Failure to do so may result in disciplinary action. Employees must follow the proper reporting procedures and, if the situation requires it under our policy, submit to a drug or alcohol test if you have an injury or accident while on the job; reference policy 301 and Appendix Corporate Safety Work Instruction
