Solicitors have also expressed concern about the implications for them of the negligence provisions in the Finance Act, 1991, where undervaluations of property are established. The Commissioners accept that solicitors have no special expertise in the area of property valuation. In their view, the obligation of solicitors under these provisions is to ensure that their clients are aware of the requirement to submit realistic valuations and that where a formal valuation is carried out, that it is done by a person who is competent and qualified to do so. A solicitor, unless he or she has knowledge to the contrary, is entitled to assume that any such person will carry out the valuation according to best professional practice. "One of the statutory conditions of the New House Grant Scheme is that either a C2 No. or a Thx Clearance Certificate Expiry Date is provided in respect of the builder. The absence of this documentation renders first-time purchasers of a new house ineligible for the £2,000 grant. "The Department has insofar as possible taken steps to ensure that applicants are aware of the conditions of the scheme. However, it is our experience that some applicants complete the purchase of their houses before applying for a grant. " It would be appreciated if in the course of advising clients, your members would ensure that they are aware of this condition, so that they are not deprived of a grant if they are otherwise eligible."
