POOL ACCESS EQUIPMENT (ADA) 86 For the Closest Location Visit LesliesPool.com/stores.htm Americans with Disabilities Act The final revisions to the Americans with Disabilities Act Accessibility Guidelines (ADAAG) pertaining to public swimming pools, wading pools and spas were signed in July of 2010. The new rules took effect March 15, 2011 and the Compliance deadline was January 31, 2013. What is the Americans with Disabilities Act (ADA)? The Americans with Disabilities Act (ADA) is a comprehensive civil rights law that prohibits discrimination on the basis of disability. The ADA requires that newly constructed and altered state and local government facilities, places of public accommodation, and commercial facilities are readily accessible to, and usable by, individuals with disabilities. The pool owner/manager should seek expert legal advice to ensure compliance. How does it apply to swimming pools, wading pools and spas? The facility must provide accessible means of entry/exit swimming pools. Such accessible means of entry include a pool lift or sloped entry, and either a transfer wall, transfer system, or pool stairs. Wading pools must provide a sloped entry, and spas must provide a pool lift,transfer wall, or transfer system. Wave action pools, leisure rivers, and sand bottom pools where user access is limited to one area shall not be required to provide more than one accessible means of entry, either a pool lift, sloped entry, or a transfer system. Which facilities need to comply? All municipal and school board pools, along with all hotels, motels, private water parks, competition facilities, etc. must comply with ADA guidelines. This includes pools operated by public park and recreation districts, hotels and motels, country clubs, high schools and universities, fitness and recreational sports clubs, water parks, hospitals and health care facilities. There are some exceptions. Apartments and private condos are considered residences and are exempt from complying with the ADA. These types of facilities fall under Fair Housing regulations. However, condos that rent out their units are considered hotels and, therefore, would be required to comply with ADA regulations. How can a facility comply? How will these requirements be enforced? Enforcement will vary from state to state, but does not change the fact that this is the law. Direct action against noncompliant facilities may be taken by local building or health officials enforcing state or health building codes that reference the new guidelines. Individuals may also file civil lawsuits against noncompliant facilities. Indirect enforcement can occur when a local government becomes ineligible for a federal grant unless facilities are in compliance.
