Chapter 11 – Mandated Reporting

The NLRB generally will not assert jurisdiction over employees of a religious organization who are involved in effectuating the religious purpose of the organization, such as teachers in church-operated schools.

2. O UTSIDE E MPLOYMENT Private employers may restrict outside employment as part of the contract of employment that it has with its employees. Employees should tie these restrictions to its desire to prevent outside employment that adversely impacts upon the employees’ position with the employer or that it incompatible with that employment. Incompatibility may be found in the following circumstances, but is not limited to these circumstances:

 employee uses school time, facilities, property, or influence for private gain;  employee accepts or receives compensation for performing the duties required by his or her position other than from the school;  employee performs an act which may later be subject to direct or indirect control, inspection, review, audit, or enforcement of another employee of the school; or  the outside employment involves time demands that would render performance of the duties of the employee’s position with the school less efficient. 1831

C HAPTER 11 – M ANDATED R EPORTING

Section 1 I NTRODUCTION The California Child Abuse and Neglect Reporting Act (“CANRA”) sets out the obligations of mandated reporters. 1832 Employees who work with minors, or have direct contact with them, are obligated to report known or reasonably suspected child abuse or neglect. Teachers and teaching assistants, lifeguards, administrators, coaches, and even summer camp counselors who are minors are just some of the positions considered to be mandated reporters of child abuse and neglect in California . The fundamentals of recognizing and reporting child abuse and neglect, as well as practical checklists and necessary forms, are discussed below in detail.
