A claim for such temporary disability compensation from the City shall be supported by a doctor’s statement explaining the employee’s limitations. During the period of an employee’s temporary disability due to a work injury, the City may require the employee to perform light or partial duties consistent with the doctor’s statement. The City of Spencer uses a Designated Physician’s Program. See City Clerk staff or supervisor for details. If an employee, other than Police or Fire employee is on worker’s compensation injury leave and is receiving temporary worker’s compensation disability benefits, the employee may utilize up to two (2) days per week of either sick leave or vacation leave to supplement their worker’s compensation disability benefits. However the employee shall be required to maintain a balance of at least one (1) week of accrued vacation and sick leave. The use of sick or vacation leave is subject to the approval of the employee’s immediate supervisor. MILITARY LEAVE A full-time employee may be granted a military leave of absence for a period up to thirty (30) calendar days without loss of pay as prescribed by Section 29.A28 of the Code of Iowa. This policy applies to all active state and federal service, including annual two weeks of field training. Schedules will be arranged in advance so that regular weekend military duty will fall on employee’s scheduled days off if at all possible. The City recognizes an employee’s reemployment right in accordance with the Uniform Services Employment and Reemployment Act. FAMILY AND MEDICAL LEAVE Recognizing the importance of family and out of concern for the well-being of its employees, the City of Spencer’s family and medical leave program enables employees to take time off, under certain conditions, for health reasons or to care for family members. This policy will be administered in accordance with the federal Family and Medical Leave Act (FMLA). A notice entitled "Employee Rights and Responsibilities under the Family and Medical Leave Act" is posted on City bulletin boards or electronically . The City will designate leave as FMLA leave if the employee is eligible for FMLA leave and if the law's other requirements are satisfied, even if the employee has not requested FMLA leave . Nothing in this policy affects or supersedes any federal or state law or collective bargaining agreement that may provide greater entitlements to medical or family leave than those set forth in this policy. All FMLA leave shall run concurrently with any approved use of sick, vacation, personal, compensatory time or worker’s compensation leave.
