DONATED PAID VACATION LEAVE POLICY It is the policy of the City of Spencer that employees may donate accrued paid vacation leave to other employees who have catastrophic health conditions or injuries and who have exhausted their accrued paid leave.

Eligible Employees A City employee shall be eligible to receive donated leave time if the employee:

1. Has completed the employment probation period. 2. Is currently a full-time City employee. 3. Has exhausted all approved sick, vacation and compensatory time. 4. Is not entitled to, or receiving, workers’ compensation benefits or other temporary disability benefits. 5. Suffers from a “catastrophic health condition or injury” defined as a life-threatening condition, or combination of conditions, or a period of disability required by his or her mental or physical health and requiring the care of a physician or licensed health care provider who provides a medical verification of the need for the employee’s absence from work for twenty (20) or more work days. Donor Eligibility Requirements 1. A full-time employee who has accrued paid vacation leave may donate up to two weeks of their paid vacation leave to the Donated Leave Bank in increments of not less than one (1) day. To donate, employee must have at least two weeks left after donation. 2. To donate paid vacation leave, an employee shall complete a Donation Leave Form provided by the City which shall be submitted to the employee’s Department Head and then to the City Manager for approval. 3. Participation in the Donated Paid Leave Program is completely voluntary. There shall be no direct request by any employee to any other employee for a contribution of paid vacation leave. 4. An employee may donate no more than two (2) weeks of paid vacation leave each fiscal year. 5. Once leave is donated to the Donated Leave Bank that donation is irrevocable and the donated leave shall not be restored to the donor. Application An eligible employee may complete a written request to receive donated paid leave on a form provided by the City which shall be submitted to the Department Head for review and then to the City Manager for approval.
