Pretrial Civil Litigation
Mr. Michael Roitman, Prof. Linda Sandstrom Simard,
3 credits day; 3 credits evening.
This course covers the pre-trial events of civil litigation from initial client interviews through the
final pre-trial conference. The course will cover civil discovery including document requests,
interrogatories and depositions. Pre-trial motions including motions to amend, to dismiss, for
sanctions and for summary judgment will also be covered in this course. Students will prepare
two legal Memoranda in support of pre-trial motions and will conduct a deposition. Students
should note that there are two discovery-related courses offered: Pretrial Civil Litigation and
Drafting Discovery Documents. The content of these courses is substantially similar and thus
students may enroll in only one of the two discovery-related courses.

Pretrial Criminal Litigation
Mr. Eddie Jenkins,
2 credits day; 2 credits evening.
The course will focus on state and federal criminal pre-trial procedures and practice, from the
complaint, arraignment, and bail stages until trial. Students will learn how to develop pre-trial
discovery as well as motions to suppress and dismiss. Although this course will discuss the
difference between the federal and state systems, the primary focus will be towards the practice
in Massachusetts Superior and District trial courts. Students will be required to prepare and argue
substantive motions and submit a final take home exam. The substantive motion will be 25% of
the grade and the take home exam is 75%. Students may not also receive credit for Criminal
Trial Tactics.
