CHAPTER 2 ADMINISTRATIVE ISSUES

EMPLOYMENT STATUS The following terms are important because many of ICMA‑RC’s personnel policies and procedures are based on employment status. ICMA‑RC recognizes the following levels of employment status:

Exempt/Nonexempt EXEMPT

Exempt associates are those who are exempt from overtime requirements under federal or state wage-hour laws, usually because their position may be classified as professional, administrative or executive in nature. Exempt associates are expected to work as many hours as needed to get their work completed and are not paid for overtime hours they may work. Conversely, if an exempt associate has to arrive late or leave early for a doctor’s appointment or school meeting, for example, he/she may do so without noting it on the time report. In most cases, prior notification is required. In all cases, business needs must be covered, and supervisors and managers are responsible for ensuring that this policy is not abused. Despite the above-stated policy, if an exempt associate is taking intermittent leave under the Family and Medical Leave Act (FMLA), each work hour must be accounted for on the time report. (See also “Compensatory Time for Exempt Associates” on page 38.) NONEXEMPT Nonexempt associates are those whose positions are eligible for overtime under federal or state wage-hour laws. These associates will be compensated for overtime for hours worked in excess of 40 hours per week or in accordance with any applicable state law. (Note that ICMA‑RC’s normal workweek is 37.5 hours. Hours worked in excess of 37.5 but less than 40 will be paid at the associate’s regular hourly rate. See “Overtime” on page 37.) ICMA‑RC complies with federal and state laws in determining whether its positions are exempt or nonexempt in nature. Questions regarding this issue should be directed to Human Resources. Regular Full-Time Associate A regular full-time associate is someone on the payroll who typically works a minimum of 37.5 hours each week. Regular Part-Time Associate A regular part-time associate is someone on the payroll who is regularly scheduled to work fewer than 37.5 hours, but at least 15 hours each week. Eligibility for and extent of compensation and benefits are based on the number of hours scheduled to work each week; for example: P P Associates regularly scheduled to work a minimum of 25 hours per week are eligible for the full ICMA‑RC
