health and welfare benefits package as well as the 401(k) plan. Vacation leave, sick leave, personal leave and holiday hours for these associates are prorated based on their regularly scheduled hours. P P Associates regularly scheduled to work between 15 and 25 hours per week are not eligible for paid leave or for ICMA‑RC health and welfare benefits but may participate in the 401(k) plan after six months. Associates working less than 15 hours per week are subject to other guidelines and should see their Human Resources manager. All Associates working in Washington, D.C., are eligible to accrue sick leave pursuant to the D.C. Accrued Sick and Safe Leave Act of 2008. Associates regularly working in other states are eligible to accrue sick leave pursuant to applicable law in those states. ICMA‑RC Temporary An ICMA‑RC temporary is a person hired by and paid through the ICMA‑RC payroll to do a specific job of reasonably predictable duration or to fill a temporary need (usually for 12 months or less). A temporary worker may be either full time or part time. Under the D.C. Sick and Safe Act of 2008, full-time ICMA‑RC temporaries are eligible to accrue 7 days of sick and safe leave each 12-month period at a biweekly rate of 2.03 hours per pay period, beginning on the date of hire. Part-time temporaries wil accrue one hour for every 37 hours worked. ICMA‑RC temporaries are also covered by ICMA‑RC’s workers’ compensation plan. In addition, they may become eligible for the 401(k) plan upon completion of 12 months service and 1,000 hours. ICMA‑RC temporaries are not eligible for any other ICMA‑RC benefits. A paid internship is generally classified as an ICMA‑RC temporary position. Agency Temporary An agency temporary is a person who works for an outside temporary services agency with which ICMA‑RC has an agreement. Agency temporaries are not employed by ICMA‑RC and, therefore, do not receive any pay or benefits from ICMA‑RC, including workers’ compensation coverage. Agency temps must pass a background check and must also agree to abide by all corporate policies including, but not limited to, the ICMA‑RC Code of Ethics and Privacy Policy. Independent Contractor An independent contractor is an individual or entity that provides services to ICMA‑RC pursuant to a contract, typically on a project-by-project basis and where ICMA‑RC controls the end result or deliverable but the contractor controls the method and manner of how the work will be performed. A contractor is not an employee of ICMA‑RC and is not eligible for benefits provided to ICMA‑RC associates. A contractor must, however, agree to abide by the ICMA‑RC Code of Ethics and Privacy Policy and other policies covering such topics as nondisclosure and data security, as well as various other ICMA‑RC requirements regarding appropriate behavior and conduct in the workplace, e.g., confidentiality of information, sexual or other harassment, and workplace safety. Additionally, contractors must also attend certain mandatory training that may be required by the corporation from time to time; such as, Code of Ethics, Security Awareness, etc. Failure to comply with these requirements could result in immediate termination of the contract.
