New NY Clean (Lien Free) Title Program Now Available

It may not seem like spring is near with all the snow still on the ground, but when

Dealers no longer have to wait up to several months to get a lien free title after paying off the loan balance of a trade-in. GNYADA’s long fought effort for legislation that allows dealers to receive a “clean title” after paying off the loan on a customer’s trade-in went into effect on January 8, 2014. Dealers continue to find themselves waiting an extraordinary amount of time to receive a lien release after the dealer pays off an outstanding loan on a car, from some banks and credit unions. The new law now allows dealers to obtain a clean title (lien free) by applying directly to the DMV after

showing proof of paying off any outstanding balance on a customer’s trade and notifying the lien holder that you will be seeking an expedit- ed clean title from DMV. DMV is required to provide a dealer, when a proper application is submitted, a clean title, within 15 days. GNYADA has prepared instructions, sample forms and letters required to apply for a clean title. GNYADA Highlights Dealer Needs at DMV 4

Long Island Dealers to join Expedited Dealer Plates/MV-50s Pilot Program Long Island dealers will be asked to participate in an expanded pilot pro- gram that expedites requests for addi- tional dealer/transporter plates, and MV-50s. This streamlined program allows dealers to make requests directly to Albany, bypassing the regional DMV inspection. Doc Fee While we were disappointed with the answer we received on our request for proper compensation for handling the State’s Registration and Title work, it did not come as a surprise. New York State still ranks as one of the lowest in the country for DOC fees. The Commissioner did agree to our pro- posal that a working group be set up that would include representatives of Dealer Associations and DMV offi- cials to look at how to reduce the bur- dens of all the paper work that DMV requires in order to reduce dealer operation’s cost. The compensation method is based on one that was adopted by two dealers in 2007 to resolve Department of Justice allegations of unintentional credit discrimination. It generally involves establishing a set amount of dealer participation that a dealer adds to a buy rate and only deviating from that amount if certain pro-competitive factors that are unre- lated to the consumer’s background are present in the transaction and are properly documented.

We would like to thank the Commis- sioner for coordinating this meeting and for making the time to address our concerns. We are very pleased to be working again with DMV to arrange for DMV to exhibit at the upcoming NY Int’l Auto Show this April. In addition to promoting the State’s new tamper free driver’s license, the Department will also be addressing the importance of not texting while driving.

Agreement Signals Truce in So-called Right-to-Repair Battle

The Alliance of Automobile Manufacturers, the Association of Global Automakers, the Automotive Aftermarket Industry Association and the Coalition for Automotive Repair Equality recently signed a Memorandum of Understanding (MOU) that is intended to call a truce over the so-called Right to Repair legislation. The MOU signed by the various groups is based on a recent law final- ized in Massachusetts (Chapter 165 of the Acts of 2013) and extends the essential provisions of the Massachusetts law nationwide. All the companies and organizations that

Governor Cuomo signed on to participate in a multi-State agreement to increase the number of ZEV’s to 3.3 million vehicles on the road by 2025. New York joined 7 other states including; California, Oregon, Connecticut, Maryland, Massachusetts, Rhode Island, and Vermont. Each State will need to come up with a strategy that will increase ZEV sales in their respective state. To further this effort, Governor Cuomo has requested that GNYADA be part of a working group involved in formulating a plan of action on how this can be accomplished such as incentives to create electrical charging stations and hydrogen fuel- ing stations to support such vehicles. The working group will also evaluate sales and tax incentives for buyers and dealers while also considering non-monitary benefits This national agreement indicates that the various industry signatories will focus on opposing individual state legislation while ALL groups will work to fully implement the MOU. It should be noted that neither NADA, nor any state dealer associa- tion, is a party to the agreement and the agreement does not address cer- tain dealer-protective provisions that were incorporated into the Massachusetts statute. It is unclear whether or not this agreement will are currently members of the signatory associations have agreed to adhere to the agreement.

The working group will include the DMV and the Department of Environmental Conservation and other Dealer Associations throughout New York State. GNYADA is committed to ensuring that dealers’ needs are met in the development of the ZEV program. Currently, sales of ZEV’s are counted when an OEM delivers them to deal- ers – even when they are not sold to a retail buyer. One of our goals will be to change that measurement to only count sales to retail or fleet customers. Education and outreach campaigns will be created to high- light the benefits of ZEV’s and increase their use.

New York City’s Right-to-Know (RTK) annual filing is due March 1st. All dealers that use, store, process, or handle any substance on NYC’s list of Hazardous Substances must file a Facility Inventory Form (FIF) with the NYC Department of Environmental (DEP) by March 1st. 9 Auto Broker Arrested on Forgery Charges

In light of the inappropriate actions of brokers and the harm caused by their unlicensed operations to dealers and consumers, GNYADA has made a request to DMV for more enforce- ment and stricter rules for these types of businesses.

The brokers arrest will likely focus new attention on automobile brokers in our area. Brokers are operating as unlicensed dealers; selling and leasing new cars, while avoiding the require- ments and expenses imposed under the Vehicle and Traffic law to operate as a new car dealership. Legislation was passed back in 2012 that requires brokers to disclose that they are brokers and not licensed franchised new car dealers. The new law also requires brokers to post a

Police became suspicious while checking a temporary out-of-state license plate on a car parked at a local community college. In addition we have invited expert counsel from the National Automobile Dealers Association (NADA) who will discuss the latest news on federal lending practices and automotive advertising. Richard Sox, of Bass, Sox and Mercer will discuss key franchise law protection issues. Clinton Praises GNYADA at NADA GNYADA was commended by former Secretary of State Hillary Clinton at the NADA Convention for its commitment to training and job creation. “When I had the privilege of repre- senting NY in the Senate, I got to know a lot of the dealers from our state. GNYADA Recognized at NADA for DEAC Contributions GNYADA was recognized at the NADA Convention in New Orleans for its efforts to raise funds for the Dealer Election Action Committee (DEAC). GNYADA ranked 12th among state and metro dealer associ- ations nationwide and ranked #1 among all metro dealer associations. Dealers in metro NY contributed $63,000 to DEAC, an increase of over $14,000 from 2012. Almost $50,000 was raised during a special phone bank, led by DEAC Chairman Gary Schimmerling of Babylon Honda. GNYADA Members Donate Over 4,000 Coats

GNYADA and its franchised new car dealer members have joined forces with New York Cares to collect and distribute more than 4,000 winter coats. Two trucks were needed to deliver the coats to New York Cares . The coats were collected by the Association and auto dealers across metro New York. “This is a great example of the community-based charitable activities that automobile dealers are known for and we are very proud to help New York Cares in their dedication to helping our areas neediest citizens,” said GNYADA president Mark Schienberg. The auto dealers surpassed their orig- inal goal of collecting 500 coats by a whopping 500%, making it the largest donation by a single organiza- tion to the New York Cares Coat Drive to date. The 2014 Social Security book- let covers changes to the social security program and provides answers to commonly asked questions. The FICA tax rate for increase of 2013 remains in effect in 2014. Employers will continue to with- hold 7.65% (6.2% Social Security Tax and 1.45% Medicare Tax) from employees’ wages. Under the Affordable Care Act high-income employees (earning in excess of $200,000) must have an additional 0.9% (Medicare Tax) withheld from wages. Employers and employees will each pay 7.65% on wages up to $117,000.
