T. Hurricane Shutters Some Fiddlesticks residents have installed window and/or door shutters for safety and security. While it is not expressly restricted in the guidelines, whenever practical and safe, shutters should be removed to maintain the appearance and aesthetics of the community.

U. Propane Tanks As of January 26, 2010, all new propane tanks that are over 100 gallons must be installed underground, and must comply with all Lee County codes and industry regulations.

V. Variances The Committee will review a request for a variance consistent with the ARC Guidelines subject to Lee County zoning approval, if needed. Before the property owner’s request for a variance is evaluated by the Committee, the ARC Administrator will send a certified notice of variance to property abutters at the requesting property owner’s expense. An application fee approved by the Board is required to cover administrative costs.

V. ARCHITECTURAL REVIEW PROCESS

Plans for all new construction and remodeling of existing homes must be approved by the Committee, including changes in exterior colors. Any modification to the exterior of the home, driveway or landscaping other than repainting using the existing color(s) must be approved using the following process prior to the work being done. In addition, any proposed or existing lighting or sound emitting features of the home that may have an impact on the Club premises or other members of the Club may be identified by the ARC committee as requiring action. Outdoor lighting that lights up any portion of one of the golf courses or common areas of the club is the sole responsibility of Fiddlesticks Country Club, and is controlled exclusively by the Board and appropriate committees. A small amount of “spill over” from backyard or security lighting will be allowed on a case-by-case basis as determined by the Board on recommendation from the Architectural Review Committee. If there are any areas where the existing property does not meet current Architectural Guidelines, these must be addressed prior to Committee approval of any new requests. The Committee will work with the property owner to assess what actions may be required or variances granted in order to bring the property up to compliance with the Architectural Guidelines. For example, a member submits an application to the Architectural Review Committee for landscaping changes. During the review process for the application, a fence was found to be installed on the property that does not meet the Architectural Guidelines, which specify height, location and landscaping requirements for fencing. The member may be asked to submit another application to the committee to address the fence issue that shows either modifications to get the fence in compliance or asks for a variance due to special circumstances. Once the fence issue has been resolved, the application for the original landscaping changes will be considered by the Architectural Review Committee. If modifications are done without prior approval, or the modifications performed do not follow the ARC approved plan, or any proposed or existing feature is found to be impacting such Club property or other members of the Club, the ARC committee will take action as described below in Section VI: ENFORCEMENT OF ARCHITECTURAL GUIDELINES – Subsection a. 1. Application Form Applications should be made in duplicate on forms provided by the Architectural Review Administrator. One form will be returned to the applicant advising approval or disapproval after a plan is reviewed. 2. Preliminary Application Prior to the preparation of construction drawings, the Committee recommends that the applicant submit a preliminary application for comments. In this manner, conceptual errors may be resolved and the possibility of a lengthy review period avoided.
