Altering Information on MV-50s If a dealership needs to change information provided on an MV-50, this does not necessarily require a new form to be generated— the original may still be accepted by the DMV, following the rules below. For most fields, the dealership may draw a line through the mistake and clearly write the correction next to or above it, in the appropriate box. The information that is being crossed out still needs to be readable by the DMV . They reject MV-50s that have been whited-out, scribbled over, or had tape pasted to cover the error. Please note the following items may NOT be corrected or altered on an MV-50: • Vehicle Identification Number • Liens • Odometer reading • Buyer’s signature • Date of sale • Dealer issued plat e numbers

THE TOP 7 DAY-TO-DAY TIPS FOR BILLERS

A few constant “rules of thumb” will assure that your dealership’s transactions are always processed quickly and efficiently. We encourage billers to keep these helpful hints in mind! Trade In titles should be carefully checked for lemon law violations or other branding (such as flood or salvage) which could affect the resulting sale. The mileage on the front of the title should also be checked, to make sure it is consistent with the vehicle’s odometer. Although many states that border New York are now also following “Cal Car” (California Car) emissions requirements , MSO swaps should always be checked for proper branding, 1 2

Incorrect entries in police books cannot be crossed out, whited-out or altered in any way. The entry must be voided and the new entry pages recorded in the left-hand column, next to the voided entry. New York State dealers may only apply for “Title Only” in the dealership name, on repossession or garagemen’s liens transactions. Title-only transactions must still undergo vehicle safety inspections. As per Dealer Plate Issuance policy, if a customer has transferrable plates, dealers are required to use those plates and cannot issue new plates.

so that the dealership is not stuck with a vehicle that cannot be registered in New York. Mileage corrections can be very difficult to process. To avoid future hassles, be sure the correct mileage is written on the back of all trade titles and odometer statements the dealership receives. The last inspection report and a signed copy of the original odometer statement can be used to correct the mileage.

DO YOU KNOW THESE FORMS?

MV-74 (Certificate of Emission Compliance or Exemption) Dealers use this form to certify a vehicle’s compliance with emission standards. It can also signify that the vehicle is exempt from emissions compliance, if there is no statement on the MCO/MSO or if the vehicle is titled out-of-state. The MV-74 must be signed by the dealer and attached to the paperwork that is submitted to DMV for Registering/Titling. This form applies only to vehicles that have 7,500 or fewer miles and are model year 1996 or newer: • passenger vehicles or light trucks (GVWR of 6,000 lbs. or less, if from before the year 2000 — GVWR of 8,500 pounds or less, if newer) • medium-duty vehicles from 2004 or later (GVWR of 14,000 lbs. or less) • heavy-duty, otto-cycle, or diesel vehicles from 2005 or later (GVWR of 14,000 lbs. or less) This form is NOT available on the NYS DMV website, but it can be obtained fromDMV-DIRECT or aMotor Vehicle office.

DTF-820 ( Certificate of Nonresidency of New York State and/or Local Taxing Jurisdiction) This form requires customers conducting transactions in New York State to certify if they are exempt from local and state sales tax. It must be used by nonresidents of NYS to confirm that they should not be subject to state sales tax, or by a NYS resident that does not live in the taxing jurisdiction where the sale takes place. The dealership is responsible for collecting sales tax for both New York State and for their local taxing jurisdiction.

A New York State driver’s license with an expired temporary visitor status is worth ZERO points toward proof of identity and cannot be used as proof of date- of-birth. A customer with an expired status does have the option to bring their license to a Motor Vehicle office and produce documents showing that their immigration status is being worked on, and have their license updated to reflect this. At that time, they will be given a new interim license with an updated visitor’s status. A copy of the interim TEMPORARY VISITOR STATUS MUST BE CURRENT

license, along with a copy of the original driver license — provided the Client ID numbers match — would be acceptable as the full six points of ID. An interim driver’s license cannot be used a proof of date-of-birth. Reminder: The IDNYC Card is worth zero points and cannot be used as proof of date-of-birth.

Scenario: Due to a clerical error, the wrong vehicle, of the same make and model as the intended vehicle, is registered and titled to a customer. So, the paperwork the customer has is not the paperwork for the car they’re presently driving. How does the dealership fix this? YOU’VE REGISTERED / TITLED THE WRONG VEHICLE — NOW WHAT?

First, confirm which vehicle the customer has in their possession. Ask the customer to record the VIN on the dashboard of the car they currently have, and report that to the dealership. If the customer has the wrong vehicle but the right paperwork, they will need to swap cars back at the dealership. Billers must notify the DMV (or their DMV service provider) that the customer is exchanging vehicles. On their end, DMV will update their system to note the vehicle the customer was wrongly driving and transfer that VIN record (for the period of time when the customer had possession of it) to the correct vehicle. If the customer is in possession of the vehicle they intended to buy, they and the dealership need to generate the correct paperwork. In order to do this, the following materials must be packaged and sent to the dealership’s DMV service provider or directly to the DMV (wherever dealership work is processed): • The correct MV-50 and MV-82, with original signatures for both the customer and the dealership. (The customer will need to return to the store to re-sign.) • An Insurance ID card for the correct vehicle, with the original dates. • A letter on dealership letterhead, detailing the issue: - Identify the vehicle (year, make, VIN) that was incorrectly registered and titled.

- Identify the vehicle that should have been registered and titled. - Note if the customer needs to return the original Title. - Include a $10.00 check payable to “Commissioner of Motor Vehicles” for the original MSO or Title to be returned. • If the correct vehicle weighs more than the incorrect vehicle, include another check (payable to the “Commissioner of Motor Vehicles”) to cover the additional registration fees. If the customer’s original Temporary Registration is still valid, the dealership can issue the temp from the corrected MV-50 with the original dates on it. If the Temporary Registration is expired, contact the DMV (or service provider) to have Albany issue an extended temp, with the correct VIN, to the customer.

We announce the following correction to the November 2016 issue of DMV-DIRECT News: In the article Proper Procedure for Accepting a “Returned” Vehicle (under “Time-Saving Tips”), the form customers must complete to have titles returned to the dealership is the MV-93 (secure power of attorney). It is NOT the MV-73, as the article misstates. We apologize for any confusion this error may have caused.

RETRACTION

All 2017 stickers should be returned by March 31, 2017.

RETURNING UNUSED 2017 INSPECTION STICKERS March 31 is the deadline for dealerships to return their unused 2017 inspection stickers, to receive their credit. To do this, follow these simple instructions:

Once processed, the DMV will send the dealership a letter revealing the credit amount. This amount can be used toward the dealership’s next order of Inspection Stickers or MV-50s. (This credit cannot be used for online orders.) Below are the mailing addresses for returning unused inspection stickers. • On dealership letterhead, draft a note that includes: – The dealership’s name, address and Facility Number. – The name and contact information of dealership contact. – A list of sticker numbers that are being returned for credit. If a dealer has multiple stores, separate letters must be written and sent for each location. • Place the returned stickers in a shipping box or envelope, along with the letter. (Do not include orders for new stickers in the same package as stickers being returned for credit; this will delay the new sticker order.) • DMV-DIRECT recommends sending this package either by certified- or overnight-mail, so it can be tracked.
