First aider or a designated person notifies and co-ordinates ambulance or medical assistance Provide information to encourage risk minimisation and enable access to first aid facilities We have seen that Regulation 42 requires the employer or business (PCBU) to provide first aid facilities. The provision of first aid facilities and services starts with identifying all the hazards in the work environment that could lead to injury or harm to the health of people at the workplace. This should be done in consultation with workers and their elected safety and health representatives. An assessment of the likelihood and consequences of the hazard leading to injury or harm will assist in identifying the means of reducing the risk to workers and the first aid services and facilities appropriate for the workplace. Hazard identification, risk assessment and risk control are covered below. Section 17 Management of ri ks A duty imposed on a person to ensure health and safety requires the person: (a) To eliminate risks to health and safety, so far as is reasonably practicable, and (b) If it is not reasonably practicable to eliminate risks to health and safety, to minimise those risks so far as is reasonably practicable. Section 17 of the WHS Act expressly provides that a duty imposed on a person to ensure health and safety requires the person to eliminate risks to health and safety, so far as is reasonably practicable, and if it is not reasonably practicable to eliminate risks to health and safety, to minimise those risks so far as is reasonably practicable. This is a risk management process. Indeed, a risk management duty has been implied in the scope of the duty of care almost from its inception. Risk Management regulations Tooma, Michael, Tooma’s Annotated Work Health and Safety Act 2011, Thomson Reuters (Professional) Australia Limited, 2012, Pyrmont, Sydney, p33- 36 Section 17.20 Clauses 32 – 38 of the Regulation prescribe a consistent process of risk management which applies wherever an express risk management duty is imposed on a person conducting a business or undertaking in the Regulation: cl 32. That process is not a general risk management as existed in all predecessor regulations (with the exception of Victoria). Rather, the process applies only to hazards specifically identified in the Regulations. That process requires hazards to be identified: cl. 34. Any risks arising from those hazards must then be eliminated so far as is reasonably practicable, or minimised so far as is reasonably practicable if it is not reasonably practicable to eliminate them cl.35. Any control of risks for that purpose is to be done in accordance with the hierarchy of control measures set out in cl.36. That hierarchy is as follows.
