TYPES OF MISCONDUCT

Misconduct is divided into 2 categories :

Both types of misconduct can result in dismissa l, although it should be noted that General Misconduct on a first offence would not result in dismissal whereas Gross Misconduct will normally result in dismissal even on a first offence .

▪ General Misconduct ▪ Gross Misconduct

General Misconduct usually refers to situations such as poor timekeeping and attendance, negligence, poor attention to duty, failure to follow procedures and refusing to follow instructions. If, following disciplinary proceedings, an employee was determined to have acted with general misconduct then they would normally receive a formal warning. Gross Misconduct refers to serious offences such as theft, fraud, fighting, being under the influence of alcohol or drugs, serious breaches of Company Policy (including Health & Safety), gross negligence, harassment, and serious or deliberate acts that can damage the company either financially or by reputation. If, following disciplinary proceedings, an employee was determined to have acted with gross misconduct then they would normally be dismissed.

The policy outlines in more detail what normally constitutes general and gross misconduct, although this is not a fully exhaustive list.
