Introduction

P OLICIES

Credit Policy All accounts will be C.O.D. until credit is approved. Future shipments after credit approval will be net 30 days with cash discounts only if specified. Whenanaccount becomespast dueall futureshipments will be subject to being placed on C.O.D. basis. Interest will be charged at the rate of 18% per annum on any balance not paid for within the terms stated on the invoice. Delivery All delivery dates for goods sold byNebraska Irrigation, Inc. are approximate only and no person shall be entitled to rely thereon. Rushor Next Day orderswill always be shipped viabest way, with full freight added to your invoice. We normally use UPS, major freight lines, or small freight carriers to ship orders. Damage Claims Freight Damage Claims All shipments must be inspected when you receive them and damages noted on the Delivery Receipt. We will not be able to help you with a freight claim if you sign a Delivery Receipt and have not identified the damaged product. All freight damage claims must be submitted within 30 days of receipt of merchandise. Wewill not be responsible for freight companies refusing to pay claims that are filed beyond the 30-day period. Concealed Damage Claims It is very important to inspect all shipments when you receive them. Immediately report any concealed damage to the delivering carrier within 15 days from the date of delivery. Youare responsible for filing claims for concealed damage. We will assist you in this process but we will not take back items that are damaged.

Discrepancy Claims You are responsible for checking your order against your packing list. Any discrepancies must be reported to Nebraska Irrigation, Inc., within 24 hours from receipt of the shipment. All claims for pricing errors, shortages, etc., must be made in writing within ten days of receipt of shipment. All claims should identify themerchandise by invoice number and date of billing. Returned Merchandise Onallmerchandise tobe returned,written“Authorization to Return”must first be obtained fromNebraska Irrigation, Inc. Nebraska Irrigation, Inc.assumes no responsibility for goods returned without such authorization. Requests for returns must refer to original invoice number and date of purchase. Unless otherwise specified, all returned goods must be shipped on a pre-paid freight basis, or shipment will not be accepted. The return of new saleable merchandise is subject to a restocking fee. Special order items are not returnable. No return will be accepted if the buyer purchased the item more than 30 days prior to the return. Warranty Products distributed by Nebraska Irrigation, Inc. are guaranteed only to the extent of the original manufacturer, which generally covers defects due to materials and workmanship on a replacement basis, F.O.B. factory. Nebraska Irrigation, Inc. shall in no event be held liable for damage or delays caused by defective goods, and no allowance will be made for repairs or alteration, unless made with written consent or approval by an officer of the company.
