Mitigation damages. Mitigation may also be the basis for an affirmative recov ery of damages for the plaintiff. See PJC 115.4. UCC cases. A buyer’s recovery of consequential damages is limited to those “which could not reasonably be prevented by cover or otherwise.” Tex. Bus. & Com. Code § 2.715(b)(1) (Tex. UCC).
