PJC 31.2
Various conduct that satisfies definition of capital murder under section 19.03 of Texas Penal Code. As appropriate, the question should include one or more of the following subparts: 1. knowingly or intentionally cause the death of a peace officer or firefighter who is acting in the lawful discharge of an official duty and who Don Davis knows is a peace officer or fire fighter; or 2. intentionally cause the death of an individual in the course of committing or attempting to commit kidnapping, bur glary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat; or 3. knowingly or intentionally cause the death of an individ ual for remuneration or the promise of remuneration or employ another to cause the death of an individual for remuneration or the promise of remuneration; or 4. knowingly or intentionally cause the death of an individ ual while escaping or attempting to escape from a penal institu tion; or 5. while incarcerated in a penal institution, knowingly or intentionally cause the death of an individual— a. who is employed in the operation of the penal insti tution; or b. with the intent to establish, maintain, or participate in a combination or in the profits of a combination; or 6. knowingly or intentionally cause the death of an individ ual— term of ninety-nine years [ for aggravated kidnap ping, aggravated sexual assault, or aggravated rob bery ]; or 7. knowingly or intentionally cause the death of more than one individual— a. during the same criminal transaction; or a. while incarcerated for capital murder or murder; or b. while serving a sentence of life imprisonment or a
