ficiary subsequently instructed the Department of External Affairs to instruct him without retaining a solicitor. A dispute subsequently arose about the Department’s statutory commission fee o f 5 per cent, which the client was unwilling to pay. A deputation was appointed to seek an interview with the Secretary o f the Department to discuss the matter and to report back to the Council. Undertaking between solicitors. A S olicitor wrote to the District Court Clerk of a local Court enclosing the papers in a Road Traffic prosecution and asking the Clerk to hand them to a solicitor present in Court who was willing to undertake the defence. The letter o f instructions stated “ Please ask the solicitor to return the papers with a note o f his fees.” The papers were handed to a member o f the Society who conducted the defence and subsequently named a fee. The fee was not paid by the instructing solicitor and the matter came before the Council for their opinion as to whether he was personally responsible. The Council expressed the opinion that the in­ structing solicitor was personally responsible for the fee named for conducting the defence or alternatively such fee as should be allowed by the Taxing Master. Coras Iompair Eireann. Settlement with client direct. T he S ecretary was directed to make repres­ entations to C.I.E. in a case in which, where a solicitor was acting, a local official o f the Company had personally interviewed the plaintiff and effected a settlement without his solicitor’s knowledge. Branch Office. M ember wrote enclosing a form of communication to clients notifying them o f the opening o f a branch office and enquiring whether it would meet with the Society’s approval. The Secretary was directed to reply that in the opinion o f the Council it is not necessary to notify clients o f the opening o f a branch office and that the proposed communication should not be sent.
