A memorandum submitted to the Revenue Commissioners is printed below. Undertaking by Solicitor AB acted for the owner o f a house which was subject to a first mortgage in favour o f clients of CD. A B ’s client was in financial difficulties and CD agreed with AB that the latter would sell the premises and that the property would be distributed in a certain way so that A B ’s client might stay in business. CD lent the documents o f title to AB on an accountable receipt in which AB undertook to indemnify CD’s clients against any loss which they might suffer as the result of handing over the
