PREǧIMPLANTATION GENETIC DIAGNOSIS UNDER THE EUROPEAN COURT … PRE-IMPLANTATION GENETIC DIAGNOSIS UNDER THE EUROPEAN COURT OF HUMAN RIGHTS’ REVIEW: AN OPENING TOWARD A WIDER ACCEPTANCE OF THE TECHNIQUE IN EUROPE? Abstract: In the judgment Costa and Pavan v. Italy , issued on 28 August 2012, the European Court of Human Rights succeeded in assuring the protection of fundamental rights in the face of important public interests, even in a field of law (as the regulation of pre-implantation genetic diagnosis) in which the discretion accorded to Member States needs to be wide. Moreover, some indicia demonstrate the Strasbourg judges’ general favour as to the application of this screening technique to avoid the transmission of serious hereditary diseases. This attitude is in line with the need to interpret the European Convention as a “living instrument” and may contribute to broadening the approval and regulation of pre-implantation genetic diagnosis in Europe. Resumé: V rozsudku Costa a Pavan v. Itálie, který vyhlásil 28. srpna 2012 Evropský soud pro lidská práva, se podařilo zajistit ochranu základních práv vůči důležitým veřejným zájmům, a to i v oblasti práva (jakou je regulace předimplantační genetické diagnostiky), kde je třeba ponechat široký prostor pro volné uvážení členským státům Rady Evropy. Navíc některé signály naznačují, že soudci ESLP vyslovili obecnou podporu screeningu techniky, aby se zabránilo přenosu vážných dědičných chorob. Tento postoj je v souladu s potřebou vykládat Evropskou úmluvu jako „živý nástroj“, a může přispět k širokému schválení a regulaci předimplantační genetické diagnostiky v Evropě.
