S AMPLE C OMMUNITY C OLLEGE D ISTRICT G RIEVANCE P ROCEDURE

Grievance Defined: A grievance is a complaint filed by an employee, group of employees in the bargaining unit, or the exclusive representative, that a specific provision of the collective bargaining agreement has been violated. Exclusions: Complaints of discrimination, harassment or retaliation, and performance evaluations are not grievable. In the event that a complaint of discrimination, harassment or retaliation is submitted as a grievance, the grievance will be treated as having been submitted under the discrimination, harassment, retaliation complaint procedure and will be processed accordingly.

Grievance Procedure: Grievances will be processed using the following procedure:

1. Informal Grievance – Immediate Administrator

Timeline: Within seven (7) calendar days of the event giving rise to the grievance, the grievant will present the grievance informally for discussion with the immediate administrator. The immediate administrator is the lowest level administrator having immediate jurisdiction over the grievant.

Resolution: The immediate administrator has fourteen (14) calendar days within which to meet with the grievant and attempt to reach a satisfactory resolution of the grievance.

Completion of the informal grievance process is a prerequisite to the institution of a formal grievance.

2. Formal Grievance – Step 1: Department Head/VP

The grievant may file a formal grievance at Step 1 with the Department Head/VP if not satisfied with the informal response.

Timeline: The Step 1 grievance must be filed within seven (7) calendar days of receipt of the informal response.

A formal grievance must be filed on the designated grievance form and contain the following information:
