a. A clear and concise statement of the violation and facts supporting the grievance, citing the specific, applicable sections of the contract, the circumstances or action from which the grievance arose;

b. The remedy sought;

c. The name, organization, address and telephone number of the grievant’s representative;

d. The grievant’s name, job title, department, contact information and signature;

e. The date upon which the informal discussion took place; and

f. The date of execution of the grievance form.

Investigation: The Department Head/VP has fourteen (14) calendar days within which to investigate the grievance, meet with the grievant, and attempt to reach a satisfactory resolution of the grievance. Decision: If a satisfactory grievance is not reached, the Department Head/VP will issue a written response within fourteen (14) calendar days of meeting with the grievant to attempt to resolve the grievance.

3. Formal Grievance – Step 2: Mandatory Settlement Conference and Voluntary Mediation

Timeline: The grievant may file a formal grievance at Step 2 of the grievance procedure, if not satisfied with the Step 1 response, within seven (7) calendar days of receipt of the Step 1 decision. At Step 2, the grievant(s), grievant representative, department representative and Human Resources representative will participate in a mandatory settlement conference in an attempt to resolve the grievance. In addition to the Step 2 mandatory settlement conference, the parties may agree to voluntarily participate in mediation at any stage in the grievance procedure to facilitate resolution of the grievance.

Unless otherwise agreed by the parties, the parties will request the assignment of a mediator from the State Mediation and Conciliation Service.

All discussions in the Step 2 settlement conference or mediation at other stage in the grievance procedure are confidential and may not be used or discussed in any subsequent proceeding. The mediator will not issue a report of findings, recommendation, or decision.
