Monitor Reports First Decline in Discipline Cases SACRAMENTO - For the first time in history, the backlog of consumer com- plaints against lawyers is decreasing in the intake, investigation and prosecution phases of the State Bar's attorney disci- pline system, according to a report due for release today. In his fourth progress report, Disci- pline Monitor ~.tt FelJmeih gives the system his most favorable review to date. The report could be important in terms ofpublic perception because it is Ute first issued since the enactment of a $33 mil- lion plan to overhaul the b r's much-eriti- cized discipline system. Fellmeth, who is director of the C ntoc fo Public Interest Law at the Univer11Jty of San Diego, has been among the most vocal and caustic critics. The $33 million 1be g-enerated over three years - including 1989 - by an an- nual $ll0 "dis'cipline enhancement" fee levied on California's pprox.imately 110,000 active lawyers. The special fee was included in the multi-year dues package approved along with the reform plan last year. The larg- est dues hike in bar history raised total dues for most lawyers from $275 to $417 in 1989. Much of the enhanced discipline fund- ing will be allocated to hire administra- tive law judges in the newly professionalized State Bar Court, sched- uled to become operational July I . The bulk of the remainder of the new moneywill be used to hire more prosecut- ing attorneys, investigators and support personnel. Tempered Optimism Fel~th and bar leaders agree the lat- est progresS"-Nport shows the system is improving. But they also stress that much work remains to be done before victory can be declared in the fight to ensure the system dispenses more justice than secrecy, leniency and delay. "For the first time m the bar's histo- ry," said Fellmeth, "the total backlog (in all three phases) is geing down. The signs are good." Bvt he added, "I'm not at all satisfied . : h ppy the r oving in the nght direction But the results are down the road a ways." Bar officials made it clear they will not rest on any laurels handed out by Fell- meth in the progress report. "It is a generalJy favorable report," said bar President Colin Wied of San Die- go. The report indicates "the system is working (and) we"re where we should be." However, Wied cautioned that "all the things we've done have yet to come lo full fruition. As long as the backlog remains, it's an ugly symbol of the past." And Sacramento lawyer Kevin Cul- hane, chairman of the bar's Committee on Attorney Discipline, said, "The only backlog acceptable to us is a zero backlog." Shortening Deadline Wied said he is pushing to accelerate the deadline for reaching that "zero" backlog in the investigation phase. When the discipline system reform plan was enacted, bar officials adopted a goal of eliminating the investigation backlog bySeptember. But Wied told The Daily Journal he has moved that deadline up by two months to July. James Bascue, head of the Office of Trial Counsel, the system's prosecutorial arm, and Clayton Anderson, chief of the Office oflnvestigation, are in the process of implementing a plan to meet Wied's new deadline. Fellmeth said the complaint backlog in intake reached a maximumofabout 1,000 five to six months ago, but has fallen to below 500. The backlog in the Office of Investiga- tion he added, has decreased in recent months from 1,800 cases to between 1,200 and 1,300. Meanwhile, the backlog of complaints awaiting drafting of formal charges by the Office of Trial Counsel has fallen from " close to 500" to about 300, said Fellmeth. "The message is basically that the (backlog) increases have st.opped," said Fellmeth. "On the other hand, we have three backlogs. USIU played without its top play- er, Demetrius Laffitte, who was side- lined with a knee injury incurred against the Aztecs. USO never trailed, but the Toreros weren't able to shake the pesky Gulls until well into the second half. USD led, 50-42, at halftime, and USIU kept it close until the Toreros made an 11 2 run to open a 70-58 lead with 8:53 to go. They extended at to 75-60 with 7:22 remaining. The teams commited 57 fouls, in- cluding 30 by USIU. USD hit 33 of 43 free throws, USIU 19 of 33. "We executed pretty well, espe- cially in the second half," said USD coach Hank Egan. Efrem Leonard's senior season hasn't been exactly what he hoped it would be. But the USD guard ~ade his final home appearance, last night against USIU, a memorable one anyway. Making only his second start of an injury-inhibited season, Leonard had 16 points, four rebounds and three as- sists to help the Toreros defeat USIU, 91-78, before 1,044 at the USD Sports Center. USIU finished its season 11-17. USD is 8-19 going into a first-round game against Pepperdine in the West Coast Athletic Conference tourna- ment Saturday at the University of San Francisco. "I'm definitely happy about ending my semor year at home this way, and maybe this will lead to some- thing better next game," said Leon- ard, who played 32 minutes. The 6-foot-l, 180-pounder from Di- amond Bar, Calif., and Mt. San Anto- nio College has endured a season in which he has bad knee, anklP, ham- string and groin injuries and a case of bronchitis. "It has been rough; I missed six games because of the hamstring and six because of a knee, that's almost half the season," Leonard said. "Last week I was about 80 percent; I'm 100 percent now." When USD met USIU a year ago, Leonard had 24 points, his second- highest output of the season (be had 28 against Loyola Marymount).
