Response to Notice of Refusal to Perform Contract Work at Brooklyn Diner

Mr. Corallo,

We are in receipt of you letter, dated February 13, 2020. We disagree with assertions that Spearhead has refused to perform contract work at the Brooklyn Diner Retail Header. Bottom line Spearhead has contract work in one area of the Retail Header; however, work at a separate area is non- contract, extra work. Contract drawings indicate carpentry (4 studs) installed below steel stiffeners at the fin-shaped awning. Spearhead included this work in its proposal. Revised drawings added framing in a separate area of a tube steel bulkhead. This framing was nonexistent in the contract documents and is extra work. Additionally, in preparation to perform its contract work, Spearhead discovered the revised drawings do not reflect the field condition. Instead of ordering materials, Spearhead began working on a proposed solution to submit as an RFI to work around the field condition. Spearhead has never refused to perform its contract work. As previously discussed with SWJV, Spearhead lacks the capacity to take on extra work at this time. Spearhead contract work includes work at “Fin-shaped” Retail Header awning Detail 2/A84-74, indicates 4 studs attached to underside of stiffening steel. During a site walkthrough in January, Spearhead affirmed it would install the 4 studs, highlighted in yellow, below. Mr. Mock shared he sent an updated RFI with revised detail and our PM, Mr. Reed, said he would review the revision.
