Table of Contents A B C D E F H I J K L List of Appendices G 6.1 When an employee enlists in the military for active duty, the employee must immediately notify the immediate supervisor/manager and provide a copy of the official set of activation orders. A benefit eligible employee must also submit a PTO request in the City’s timekeeping system if the employee wants to use any paid leave during the deployment. At the end of any paid leave used, the 5.2 Employees who return to work in less than five years will be returned to the same or like position they occupied prior to the active duty enlistment with full seniority, status and pay as if there had been no break in employment. A military discharge form DD-214 with an honorable discharge must be submitted with the notification of intent to return to work. USERRA’s cumulative 5-year limit does not include certain kinds of military training or service. Contact the Benefits Specialist for more information. 5.3 Time limits for employees to reapply for return to work after release from military service are: A. Less than 31 days absence - employee must report to employer by the next business day. B. 31 days to 180 days absence - notification to the supervisor must be submitted within 14 days. C. More than 180 days absence - notification to the supervisor must be submitted within 90 days. 5.4 An employee returning to City employment following an active duty enlistment must be able to perform the duties of the formerly assigned position or a position of like classification. 5.5 Provisions for Deployed Benefit Eligible Employees A. Benefit eligible employees will not accrue annual and sick leave while on leave without pay while serving on active duty. B. For departments that award holidays in advance, employees will be awarded holidays on a pro-rata basis, depending on when the employee actually returns. C. Salary increases and changes in job level will be tracked during the employee’s absence so that re-entry to employment is at the appropriate level. D. The employee on active duty may choose to drop or continue insurance. The City will contribute the same amount to the active duty employee’s insurance as when the employee was in an active pay status with the City. E. The benefit eligible employee will receive full service credit with the Retirement System after returning from military service provided when returning to work within the guidelines stated above in Section 5.3. In order to receive the retirement service credit, the returning employee must furnish the military discharge form DD-214 to the People & Culture (P&C) Benefits staff upon return to work. 6.0 PROCEDURES
