Table of Contents A B C D E F H I J K L List of Appendices G Title VII of the Civil Rights Act of 1964 - A Federal law enforced by the Equal Employment Opportunity Commission that prohibits discrimination in the terms and conditions of employment, including benefits, on the basis of race, color, religion, sex and national origin. USERRA (Uniformed Services Employment and Reemployment Act of 1994) - A Federal law enforced by the Veterans Services Division of the United States Department of Labor that requires service members who are returning from military service be reemployed in the position the service member would have obtained had the service member not been absent for military service with created the unemployment insurance program. This is a combination Federal and State employer paid benefit, enforced in North Carolina by the North Carolina Employment Security Commission, which provides for partial wage replacement for up to 26 weeks to employees who through no fault of their own lose their jobs. HIPAA (Health Insurance Portability and Accountability Act of 1996) - A Federal law, enforced by the United States Department of Health and Human Services, that governs the privacy of protected health information as well as personal data, and provides for portability of health and dental benefit eligibility. NCLGERS (The North Carolina Local Governmental Employees Retirement System) - A defined benefit retirement system for local governmental employees created by Chapter 128 of The General Statutes of North Carolina. In 1986, the Law Enforcement Officers Retirement System was merged with other retirement systems and local law enforcement officers became a part of NCLGERS. The Law Enforcement Officers section of NCLGERS has somewhat different benefits. The 1986 legislation, effective January 1, 1987, also created two additional mandated benefit programs for local law enforcement officers, the Supplemental Retirement Income Plan 401(k) and the Police Separation Allowance. Employees contribute 6% of income to the retirement system and the City makes an actuarially equivalent contribution. In addition the City contributes a mandated 5% to the Police 401(k) and the payroll amount necessary to fund the Police Separation Allowance. The City has also chosen to provide the voluntary death benefit under NCLGERS. Pregnancy Disability Act of 1978 - An amendment to Title VII of the Civil Rights Act of 1964, the Pregnancy Disability Act is a Federal law enforced by the Equal Employment Opportunity Commission that prohibits discrimination in the terms and conditions of employment, including benefits, on the basis of pregnancy, childbirth or related medical conditions. These conditions must be treated as any other medical condition. Section 125 of the Federal Internal Revenue Code (CityFlex) - A Federal law enforced by the United States Internal Revenue Service that provides for an employee to voluntarily reduce the employee’s salary by a specified amount, which also reduces the employee’s income taxes and social security taxes. These funds may be used to reimburse the employee on a tax free basis for out of pocket expenses associated with certain benefit programs - such benefits are health and dental premiums, parking in a City facility paid through payroll deduction and CityFlex medical and day care spending accounts.
