Proposed Revision to Canon 27, Section 2

Section 2. Disciplinary Board. (a)

(a) Subject to the provisions of Section 3, below, the Disciplinary Board shall consist of seven thirteen persons, four (4 seven (7 ) of whom are members of the clergy and three (3 six (6 ) of whom are members of the laity. The clergy members of the Disciplinary Board must be canonically and geographically resident within the Diocese of Southwestern Virginia. The lay members of the Disciplinary Board shall be adult communicants in good standing of this church , and geographically resident in this diocese. (b) Five (5) clergy members of the Disciplinary Board and four (4) lay members of the Disciplinary Board shall be elected by the Convention (the “Elected Disciplinary Board Members”). Three (3) clergy members of the Disciplinary Board and three (3) lay members of the Board shall be appointed by the Ecclesiastical Authority (the “Appointed Members of the Disciplinary Board”). (1) (b) At each annual Convention, the Convention shall elect one (1) or two (2) clergy member(s), as necessary, and one (1) lay member to the Disciplinary Board, each for a term of three (3) years, to replace the members whose terms are expiring. (c) The terms of members elected to the Disciplinary Board shall commence on the first (1st) business day following election. (2) The Ecclesiastical Authority from time to time shall appoint the Appointed Members of the Disciplinary Board as necessary to maintain the required number of Appointed Members of the Disciplinary Board. The term of each person so appointed shall be for three years; provided however, that for the six persons appointed in 2018, one clergy member and one lay member shall be appointed for a term of one year, one clergy member and one lay member shall be appointed for a term of two years, and one clergy member and one lay member shall be appointed for a term of three years. The first year of the term all such persons appointed in 2018 shall be deemed to end on the last day of the 2019 Annual Convention. The terms of members appointed to the Disciplinary Board shall commence on the day such member accepts the appointment. (c) (d) Members of the Disciplinary Board may be reelected or reappointed and succeed themselves. (d) (e) Members of the Standing Committee shall be eligible to serve on the Disciplinary Board. (e) (f) Vacancies on the Disciplinary Board shall be filled as follows: (1) Vacancy Arising from Departure of Elected Disciplinary Board Member.
