Conflict of Interest Policy

Members of the Board of Directors should always act in the best interest of the Bobby Nichols- Fiddlesticks Foundation, Inc. and avoid activities which conflict with or which appear to conflict with their responsibilities to the organization and its members and contributors.

The Bobby Nichols-Fiddlesticks Foundation, Inc. (“Foundation”) is a nonprofit organization formed to generate funds to return to the community via charitable organizations, which serve abused and underprivileged children. The Foundation’s Board of Directors (“Directors”) are chosen to serve the purpose to which the Foundation is dedicated and they have a duty to conduct the affairs of the organization in a manner consistent with such purposes. At times, this service may conflict with the personal interests of the Directors. Service in the nonprofit sector carries with it important ethical obligations. When the personal or professional concerns of a Director affects his or her ability to put the welfare of the Foundation before personal benefit, a conflict of interest exists. Thus, it is important for the Foundation and its Directors to identify, evaluate and address any conflicts of interest that might, in fact or in appearance, call into question such persons’ responsibilities to the organization. Therefore, in the course of meetings or activities, Directors will disclose any interest in a transaction or decision where they, including their business or other non-profit affiliation, their family and/or significant other or their employee(s), will receive a benefit or gain. Furthermore, the Director will refrain from using his or her personal influence to affect the decision or activity and refrain from active participation in any discussions regarding the conflict of interest except to respond to requests for information about the conflict of interest. And finally, the Director will refrain from voting on any decision or action in which they have a conflict of interest. In the event there is doubt as to the existence of a conflict of interest, the matter shall be resolved by a vote of the Directors without the participation of the person concerning whose situation the doubt has arisen.

And finally, this policy is meant to supplement good judgment and all Directors are expected to respect its spirit as well as its wording.

Annually a copy of this policy shall be furnished to each Director of the Foundation and they shall certify that they are in compliance.

THE EARL HOLLAND MEMORIAL SCHOLARSHIP FUND PROPOSAL

 The Foundation would create a new charity recipient-- THE EARL HOLLAND MEMORIAL SCHOLARSHIP FUND.

 Criteria for recipient selection would be established such as former experience at ACT or CAC, good grades, academic and/or athletic success in high school, acceptance at an accredited college or university, determining other scholarships being received, etc.

 ACT & CAC would recommend a recipient; the Charity Selection Committee would conduct an appropriate evaluation of the nominee (including an interview at the ACT/CAC location) and then make a recommendation to the Board for approval.

 Funding would come from the annual proceeds of the Nichols Cup events. Initial funding may come from this season’s Special Needs appeal and/or Memorial donations.

 Checks would be presented to the recipients at the Annual Meeting provided that ACT & CAC are comfortable with this idea. Jill Turner did not see this as a problem as long as we do not disclose that they are/were a client and also the details of their abuse.

Other Funding o

To assist in kick starting the program, Debbie & Ken Burnside have generously offered to donate a concert by Johnny Vincent, the singer from Chicago who sang at our Sunday Night Nichols Cup dinner. The Burnsides could host a private event at the club, charge $200+ per head for a nice dinner and they would send out an announcement to the entire community. They could run the event in Nov, Dec or Jan and then personally donate the net proceeds back to the Foundation, earmarked for the Earl Holland Memorial Scholarship Fund. As it is being hosted by them at the club and attendance is completely voluntary it would not come across as yet another solicitation from the Foundation. Benefits o Focus on “a silver lining in the cloud” as a former abuse victim rises above and moves forward with their life in a positive way o A great marketing/PR opportunity for the Foundation o A wonderful way to honor Earl We would need to decide amounts & number of years for the awards. The consensus was to make it a one year award and a set amount which would be determined annually based on funds available. o Designating all of the appeal funds may reduce the amount of the other charity’s awards unless net revenue separate from Special Needs has a significant increase. o We may wish to consider technical and trade schools as a recipient’s choice of post high school education Areas to Address o

HISTORY The Bobby Nichols Fiddlesticks Charity Foundation, founded in 2002, is a group of Fiddlesticks members, known as Pipers, who volunteer to organize and run an annual celebrity pro-am invitational golf tournament for the following purposes:

MISSION STATEMENT 1.

Generate funds to return to the community via charitable contributions. These contributions have been earmarked for abused and underprivileged children. 2. Recognize the contributions and accomplishments of Bobby Nichols, winner of 14 PGA Tour tournaments including the 1964 PGA Championship and 1974 Canadian Open. (Bobby has been a resident of Fiddlesticks since its inception.) Fourteen tournaments have raised over $8,000,000 for local children’s charities. Funds are raised through golf, and tennis events with tournament sponsorships, raffles, live and silent auctions.

Dear Fiddlesticks Friends:

Fourteen years ago a group of neighbors contacted me about starting a Foundation in my name. I was honored and truly humbled to even be considered for such an amazing tribute. At that time I could not begin to imagine all that we would accomplish together in the war against child abuse and neglect. At a time of year when counting our blessings and being thankful is on our minds, I wanted to offer my sincerest gratitude for the legacy you have created not only for our community but for me, my family and for generations to come. This legacy all begins with the Pipers. Some of you may be new to the community and don’t know exactly what this great group of friends is all about. The Pipers are simply neighbors that commit to helping these children and leading our community in the fundraising efforts every year. Think of us as “brothers and sisters in arms” working to end child abuse and neglect right here in our area. We can proudly state that 100% of all Piper dues go directly to programs supporting these children. In 2016 we had 516 Members with dues in excess of $72,000. Fiddlesticks can be proud of the fact that in the last 14 years we have raised $8,089,100 for abused and neglected children in the Fort Myers area. We could not do this without the generosity of our dedicated Pipers. As a Piper, we invite you to join us in April for our annual meeting where complimentary food and beverages will be available to celebrate all the accomplishments of the season. During the February event weekend we have shortened the festivities to include events on Saturday, Sunday and Monday only. Saturday night will now be called the Fiddlesticks Neighborhood Celebration and will invite all members to join together to help abused and neglected children. There will be small fee associated with the Saturday evening event, as in years past. As a thank you for all you have done over the last fourteen years I have enclosed a car/cart sticker for your enjoyment. Please display it proudly on the lower passenger side of your cart windshield, per the Club’s rules and regulations. Showcase it to friends and colleagues. Use it as a way to start a conversation about the amazing kids that need our help. We know on Thanksgiving we will all enjoy a bounty of food, laughter with family and friends and above all the security and comfort of knowing we are loved. Please stand together with me for these children and let them know we are never going to forget about them. We will continue to fight and raise the funds needed so that help can intervene before it’s too late.

Every child deserves happy childhood memories and together we can make a difference by becoming Pipers.
